A CLARIFICATION TO CITY OF PLAINVIEW, CITY COUNCIL
RESOLUTION R20-480 REGARDING THE FILING OF A GRANT
APPLICATION WITH THE OFFICE OF THE GOVERNOR, CRIMINAL
JUSTICE DIVISION THROUGH THE SOUTH PLAINS ASSOCIATION OF
GOVERNMENTS FOR THE CORONAVIRUS EMERGENCY
SUPPLEMENTAL FUNDING PROGRAM BY CLARIFYING THAT THE
REQUEST FOR SUCH FUNDING IS FROM THE CRIMINAL JUSTICE
DIVISION OF THE OFFICE OF THE GOVERNOR AND NOT FROM THE
TEXAS DIVISION OF EMERGENCY MANAGEMENT.
WHEREAS, on May 26, 2020, the City Council of the City of Plainview approved
Resolution R20-480 authorizing the Mayor and City Manager to request funding from the
Office of the Governor, Criminal Justice Division, who is administering funds known as
the Coronavirus Emergency Supplemental Funding (CESF) Program received from a
Congressional appropriation of federal funds to the U.S. Department of Justice, Bureau
of Justice Assistance, for certain expenses incurred as a result of the novel coronavirus
(COVID-19) pandemic; and
WHEREAS, all recitals contained in Resolution No. R20-480 approved by the City
Council properly referenced the CESF Program and the Criminal Justice Division of the
Office of the Governor as the proper administrative agency administering the CESF
Program; and
WHEREAS, the approved City Council minutes of the Council meeting conducted
on May 26, 2020 properly referenced the CESF Program and the Criminal Justice Division
of the Office of the Governor as the proper administrative agency administering the CESF
Program; and
WHEREAS, all supporting documentation provided to the City Council regarding
this agenda item for the Council meeting conducted on May 26, 2020 properly referenced
the CESF Program and the Criminal Justice Division of the Office of the Governor as the
proper administrative agency administering the CESF Program; and
WHEREAS, one paragraph of Resolution No. R20-480 mistakenly references the
Texas Division of Emergency Management as the administrative agency of the CESF
Program and not the Criminal Justice Division of the Office of the Governor; and
WHEREAS, the Mayor and/or City Manager of the City of Plainview were
authorized by the City Council in Resolution No. R20-480 to administer and oversee all
matters relating to the CESF grant application and to execute all necessary documents
related to the CESF grant application and grant acceptance; and
WHEREAS, the Criminal Justice Division of the Office of the Governor has advised
the City of Plainview that the mistakenly referenced agency in Resolution R20-480 must
be corrected by April 30, 2021 and must include assurances that, in the event of loss or

misuse of grant funds, the governing body will return all funds to Public Safety Office of
the Criminal Justice Division of the Office of the Governor; and
WHEREAS, it is clear from the approved minutes of the City Council, the
supporting documentation for Resolution No. R20-480 and the recitals contained in
Resolution No. R20-480 that the intent of the City Council was to authorize the Mayor and
City Manager to request funding from the Criminal Justice Division of the Office of the
Governor and any reference to the Texas Division of Emergency Management was an
inadvertent mistake;
NOW, THEREFORE, AS THE MAYOR OF THE CITY OF PLAINVIEW AND THE
HEAD OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, I HEREBY ENTER THIS
CLARIFICATION TO RESOLUTION NO. R20-480 NUNC PRO TUNC:
1. THAT any reference to the Texas Division of Emergency Management in
Resolution No. R20-480 is hereby replaced by the Criminal Justice Division of the Office
of the Governor.
2. THAT in accordance with the authority granted the Mayor and City Manager of the
City of Plainview to administer and oversee all matters relating to the CESF grant
application and to execute all necessary documents related to the CESF grant application
and grant acceptance, the City of Plainview provides assurance that, in the event of loss
or misuse of grant funds, the governing body will return all funds to Public Safety Office
of the Criminal Justice Division of the Office of the Governor.
3. THAT all other substantive terms of Resolution No. R20-480 are not altered or
amended by this clarification and remain in full force and effect until amended or altered
by the City Council of the City of Plainview.
