R21-525 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, AUTHORIZING THE CITY MANAGER OF THE CITY OF PLAINVIEW, TEXAS, TO COMPLETE AND SUBMIT THE NECESSARY PAPERWORK FOR THE CORONAVIRUS STATE AND LOCAL FISCAL RECOVERY FUNDS; DESIGNATING THE MAYOR AS THE AUTHORIZED REPRESENTATIVE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a novel coronavirus (COVID-19) has been recognized globally as a contagious respiratory virus; and WHEREAS, pursuant to Texas Government Code §418.108(a), the Mayor issued a declaration of local disaster on March 18th due to the COVID-19 pandemic that has been continuously renewed and extended by the Mayor and City Council of the City of Plainview since that time; and WHEREAS, on July 1, 2021, the Governor of the State of Texas renewed his state- wide disaster proclamation for an additional thirty (30) days, certifying that COVID-19 poses an imminent threat of disaster for all counties in the State of Texas; and WHEREAS, Congress passed the American Rescue Plan Act, Pub. L. No. 117-2 (March 11, 2021), that provides $350 billion in emergency funding for eligible state, local, territorial, and Tribal governments to respond to the COVID-19 emergency; and WHEREAS, Sections 602(b) and 603(b) of the Social Security Act, as added by section 9901 of the American Rescue Plan Act, authorizes the U.S. Treasury Department to make payments to certain recipients from the Coronavirus State Fiscal Recovery Fund and the Coronavirus Local Fiscal Recovery Fund; and WHEREAS, non -entitlement units of local government are defined in section 603(g)(5) of the Social Security Act, as added by section 9901 of the American Rescue Plan Act, are local governments typically serving populations of less than 50,000 and are eligible to receive Coronavirus Local Fiscal Recovery Fund payments through their state government; and WHEREAS, the Coronavirus State and Local Fiscal Recovery Funds provide substantial flexibility for each government to meet local needs including support for households, small businesses, impacted industries, and essential workers; and WHEREAS, the Coronavirus State and Local Fiscal Recovery Funds can also be used to make necessary investments in water, sewer, and broadband utility infrastructure; and WHEREAS, the State of Texas will receive a specific allocation of Coronavirus Local Fiscal Recovery Funds from the U.S. Treasury Department for the above mentioned purposes and are responsible for distributing these funds to non -entitlement units of local Page 1 of 2 238 governments within Texas and must distribute these funds to its non -entitlement units of local government within thirty (30) days of receiving such funds unless granted an extension by Treasury; and WHEREAS, the City of Plainview is considered a non -entitlement unit of local government and has been identified to receive a total allocation of $4,991,152 disbursed in two tranches approximately twelve months apart of $2,495,576 each; and WHEREAS, the City Council of the City of Plainview believes it to be in the best interest of the citizens of the City of Plainview to authorize the Mayor and/or City Manager to submit the necessary documents and paperwork in order to receive Coronavirus State and Local Fiscal Recovery Funds as authorized under the American Rescue Plan Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, HEREBY RESOLVES THAT: 1. THAT the City Manager of the City of Plainview, Texas, is hereby authorized to complete the submission for Coronavirus State and Local Fiscal Recovery Funds and all related or necessary documents related to such submission. 2. THAT the Mayor of the City of Plainview, Texas and the City Manager are designated as the Authorized Representatives for the City of Plainview and are authorized to execute, on behalf of the City of Plainview, any and all necessary documents related to the submission for Coronavirus State and Local Fiscal Recovery Funds. 3. THAT the Mayor and/or City Manager of the City of Plainview are hereby authorized to administer and oversee all matters relating to the submission for Coronavirus State and Local Fiscal Recovery Funds and/or receipt of Coronavirus State and Local Fiscal Recovery Funds. 4. THAT the City of Plainview, to the best of its ability, agrees to comply with the terms and conditions for receiving Coronavirus State and Local Fiscal Recovery Funds. 5. THAT this Resolution shall be effective immediately upon its passage. Approved by the City Council of the City of Plainview, Texas, this 22nd day of July, 2021.
