RESOLUTION NO. R21:-536
A RESOLUTION OF THE CITY'COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS., ORDERING A SPECIAL ELECTION BY THE VOTERS IN
DISTRICT 'NO. 7, TO ELECT A PERSON TO FILL THE VACANCY AND
UNEXPIRED TERM CREATED ' BY THE RESIGNATION OF THE
COUNCIL MEMBER FOR THAT DISTRICT; TO OCCUR ON: JANUARY
22, 2022 IN ACCORDANCE WITH THE TEXAS ELECTION CODE.
WHEREAS, on August.24, 2021 at a regular City Council meeting, Patra Moreno,
Council Member for District Na. 7, tendered her written resignation of her office to the City -
Council and it was accepted by the City Council; and
WHEREAS on September 14, 2021, due to fact that no candidate filed to run for
the vacant Council seat. for -Council Member for District .7, the City Council declared that
such seat is vacant and shall remain vacant until such time :as the City Secretary prepares
the necessary documents for the City Council to call for another special election -to fill
such vacancy; and
WHEREAS, Article II, Section 2.06(c) of the Plainview City Charter requires a_
special election be :called within 120 days of the creation of a vacancy to fill the unexpired
term of that office; and
WHEREAS, there exists a.need for a Special Election for voters in District:No. 7;
to fill. the vacancy in the seat for 'District .No. 7, as required by the Charter of the City of
PlainvieW;' and
WHEREAS, the Election shall be held on the .Saturday, January 22, 2022; and.
WHEREAS, Section 85.0.05 (d) of the Texas Election Code further requires:that:in
an Election ordered by a city, early voting by personal appearance -at the main early voting
polling place shall be conducted for at :least 12 hours: (1) on ;one weekday:, if' the early
voting period consists of less than six Weekdays; or (2) on two weekdays, if the early
voting period: consists of six or more weekdays; .and
WHEREAS, all persons qualified to vote in said Election under the Election Laws
of1he State of Texas shall be allowed to vote therein. .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW;.TEXAS, THAT:,
SECTION 1
A Special Election shall be, held in the City :of Plainview, Texas on the 22"d .day of:
January 22, 2022. Said Election is to elect a Council Member for District 7 to serve until
May 2; 2024, the unexpired term of Council- Member Patra Moreno.

SECTION 2
Applications for a place on the City of Plainview- Special Election ballot may be
filed beginning November 10, 2021 through November 22, 2021 at 5.00 p.m. The
applications should be delivered to the City Secretary at 202 W. 5th, Plainview, Texas
79072.
SECTION 3
All electors shall vote in the voting district in which said voter resides, and at the
polling place provided for voting as designated in Section 4 of this Resolution.
SECTION 4
The election shall be held within the municipal limits of the -City of Plainview
between .the hours of 7.00 a.m. and 7:00 p.m. on January 22, 2022. The Election shall
occur at the following designated polling place(s), and with the election officers appointed
to hold said Election:
Coronado Middle School
2501. Joliet
Plainview; Texas 79072
SECTION 5
Early voting by personal appearance. will be conducted- each weekday at 202 W.
5th Street, Plainview, Texas between the ':hours of 8:00 a.m. and 5:00 p.m. beginning on
January 5, 2022 and ending on January 18, 2022. On Thursday, January 6, 2022 and
Thursday, January 13, 2022 early voting by personal appearance will be conducted
between the hours of 7:00 a.m. and 7:00 p.m. as required by Section 85.005 (0) of the
Texas Election Code.
Said election shall have as its Early Voting Ballot Board :presiding election judge, Jackie
Lopez.
SECTION 6
it is further ;provided that the hourly rate for presiding election judges shall not
exceed $10.00 per hour, and the hourly rate for clerks shall not exceed $8.00 .per hour.
SECTION 7
A copy of this resolution shall also be served upoh:the election officials designated
to hold the election.
SECTION 8
Notice:of this:Election shal[be given in accordance with the provisions of the Texas
Election Code and returns of such notice shall be made as provided, for in said Code.
