A RESOLUTION AUTHORIZING THE SOLE SOURCE PURCHASE OF
STRYKER LIFEPAK HEART MONITOR/DEFIBRILLATORS
WHEREAS, the City of Plainview is a home -rule municipality and a political
subdivision of the State of Texas duly organized and operating under the laws of the State
of Texas; and
WHEREAS, the City of Plainview maintains and equips the City of Plainview Fire
Department that provides vital emergency fire and medical response throughout the City
of Plainview and in Hale County; and
WHEREAS, as part of providing this emergency fire and medical service for the
public health and safety of the citizens of Plainview and Hale County, it is necessary for
the City of Plainview to procure, maintain and operate certain emergency medical
equipment including defibrillators; and
WHEREAS, the City has received notice that a certain Stryker Life Pak Heart
Monitor/Defibrillators used by the Plainview Fire Department will be discontinued due to
regulatory changes; and
WHEREAS, Stryker, the company that manufactured the discontinued heart
monitor/defibrillator is offering an opportunity to the City of Plainview to trade-in the
existing monitors and purchase new ones at a discounted cost; and
WHEREAS, Stryker is the sole -source provider in the United States for the
monitor/defibrillators designed as a replacement for the discontinued defibrillators
currently utilized by the City of Plainview Fire Department and has provided a sole source
letter for the City to purchase this directly from Stryker; and
WHEREAS, the City of Plainview believes that replacing the discontinued
monitor/defibrillator as soon as possible is in the best interest of the City in order to protect
the public health and safety of the citizens of Plainview and Hale County; and
WHEREAS, as a municipality and political subdivision of the State of Texas the
City of Plainview is required to follow the competitive bidding requirements of Chapter
252 of the Texas Local Government Code; and
WHEREAS, Texas §252.022(a)(2) of the Texas Local Government Code exempts
from competitive bidding requirements a "procurement necessary to preserve or protect
the public health or safety of the municipality's residents" and §252.022(a)(7) of the Texas
Local Government Code exempt from competitive bidding requirements a "procurement
of items that are available from only one source"; and

WHEREAS, the City Council of the City of Plainview believes it to be in the best
interest of the citizens of Plainview in order to protect the health, safety and welfare of the
citizens of Plainview to procure a monitor/defibrillator from Stryker under the exemptions
mentioned above;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW THAT:
1. The recitals and findings outlined above are approved, adopted and
incorporated herein as though set forth fully herein.
2. The City Manager of the City of Plainview or his designee is hereby
authorized to purchase a Stryker LIFEPAKO 15 monitor/defibrillator with all necessary
attachments and accessories as recommended by the City of Plainview Fire chief without
following the competitive bidding requirements of Chapter 252 of the Texas Local
Government Code pursuant to the exceptions provided in §§252.022(a)(2) and
252.022(a)(7) of the Texas Local Government Code or any other applicable exception
provided by law.
