HomeMy WebLinkAboutCouncil Minutes 01-25-2022106 The City Council of the City of Plainview met on January 25, 2022 at 6:30 p.m., in the Council Chambers, 202 W. 5th Street, Plainview, Texas. Mayor Charles Starnes presided. Council Members present were Nelda VanHoose- District 1, Larry Williams -District 2, Norma Juarez -District 3, Evan Weiss -District 6 and Lorie Rodriguez -District 7. Mayor Pro Tern Susan Blackerby-District 5 was in attendance by video conference. Council Member Teressa King -District 4 was absent. Staff members present were: Jeffrey Snyder -City Manager, Matt Wade -City Attorney, Jeff Johnston -Assistant City Manager, Sarianne Beversdorf-Di rector of Finance, Isauro Gutierrez -Director of Information Technology, Derrick Watson -Chief of Police, Bobby Gipson -Fire Chief, Tim C rosswhite-Di rector of Public Works, Neil Weems -Assistant Director of Public Works, and Melinda Brown -Main Street Manager. An Ordinance of the City of Plainview, Texas, Adopting a Redistricting Plan Revising the Seven Single Member Council Districts Boundaries in Response to the 2020 Census; Providing for an Effective Date; Providing for Severability; and Providing for Publication of the Caption Thereof (Ordinance No. 22-3724 — Second Reading) Since this was the second of two readings, the Council chose to forego staff briefing Public Comment: None Motion: Move to adopt Ordinance No. 22-3724 on second reading Motion by Council Member Weiss seconded by Council Member Juarez Vote: 7-0. Motion carried. 7. An Ordinance Amending Chapter 6, "Health and Sanitation", Article 6.05, "Ambulances", Division 3, "Private Transfer Ambulances", Section 6.05.068 and Section 6.05.070 of the Code of Ordinances of the City of Plainview Eliminating Certain Staffing Requirements for Transfer Ambulance Services; Providing an Effective Date; Providing for a Penalty not to Exceed $500.00; Providing for a Severability Clause; and Providing for Publication of the Caption Thereof. (Ordinance No. 22-3725 — Second Reading) Since this was the second of two readings, the Council chose to forego staff briefing Public Comment: None Motion: Move to adopt Ordinance No. 22-3725 on second reading Motion by Council Member Juarez seconded by Council Member VanHoose Vote: 7-0. Motion carried. 8. A Resolution Accepting the Dedication of Rights -Of -Way and Utility Easements as Depicted in the Plat of Wilcox Addition, Tract "A" Through Tract "D" Located at 3600 Olton Road, Plainview, Hale County, Texas (Resolution R22-548) Presenter: Jeff Johnston, Assistant City Manager Property is being platted into four tracts. A blanket easement is dedicated for garbage collection and utility installation. Public Comment: None Motion: Move to adopt Resolution R22-548 Motion Council Member Weiss, seconded by Council Member Juarez Vote: 7-0. Motion carried. 9. A Resolution of the City Council of the City of Plainview, Texas Amending Main Street Program/Tourism Coordinating Board By -Laws (Resolution R22-546) City Council Minutes January 25, 2022 Page 2 of 4 107 10 Presenter: Melinda Brown, Main Street Manager Plainview Downtown Association and the Main Street Program merged into one organization under the Main Street Board in 2021. One of the changes initiated by the merger is an update to the Main Street By -Laws. This Resolution revises those By -Laws. Public Comment: None Motion: Move to adopt Resolution R22-546 Motion by Council Member Juarez, seconded by Council Member Rodriguez Vote: 7-0. Motion carried. 10. A Resolution of the City Council of the City of Plainview, Texas, Stating That the City Council Has Reviewed and Adopted an Investment Policy in Accordance with Texas Government Code Chapter 2256, the Public Funds Investment Act, Requiring the Governing Body to Review Investment Policy as Well as Investment Strategy for Public Fund Investment; and Declaring an Effective Date (Resolution R22-547) Presenter: Sarianne Beversdorf, Director of Finance This Resolution states that the City Council has reviewed and adopts the City of Plainview Investment Policy in accordance with the Texas Public Funds Investment Act. Public Comment: None Motion: Move to adopt Resolution R22-547 Motion by Council Member Weiss, seconded by Council Member VanHoose Vote: 7-0. Motion carried. 11. Consider authorize purchase and services for IT assessments, IT strategic planning through the TIPS Purchasing Cooperative, TIPS Contract No. 200601 Presenter: Isauro Gutierrez, Director of Information Technology This authorizes an Information Technology Strategic Plan which allocated in the 2021- 2022 Budget. Public Comment: None Motion: Move to approve Item No. 11. Motion by Council Member Williams, seconded by Council Member Juarez Vote: 7-0. Motion carried. Convene into closed session pursuant to Texas Gov't Code § 551.087 to discuss 109 or deliberate regarding an offer of a financial or other incentive to a business prospect that the Citv seeks to have locate, stav, or expand in or near the territory of the Citv of Plainview. 13. Convene into closed session pursuant to Texas Gov't Code § 551.072 to deliberate the purchase, exchange, lease or value of real property, the public discussion of which would not be in the best interest of the City's bargaining position with third parties. 14. Convene into executive session in accordance with Tex. Gov't Code §551.071 to seek the advice about pending or contemplated litigation, settlement offers or on matters in which duty of the attorney under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas conflicts with Tex. Gov't Code Ch. 551 Construction - Lone Star Settlement Mayor Starnes recessed the meeting at 7:25 p.m. Mayor called the meeting back in open session at 8:07 p.m. Motion: Move to approve the settlement with Lone Star Dirt and Paving and authorize the City Manager to execute any and all documents necessary to effectuate the same Motion by Council Member Weiss, seconded by Council Member Juarez Vote: 7-0.
