Mayor Charles Starnes presided. Council Members present were Mary Elizabeth Dickerson -District 1, Steve Martinez -District 2, Mike McDonough -District 3, Gary House - District 4, Susan Blackerby-District 5, Evan Weiss -District 6 and Lorie Rodriguez -District 7. Discussion on FY 2022-2023 Proposed Budget and Consider Proposed Property Tax Rate for Fiscal Year 2022-2023 and Schedule Public Hearings Presenter: Jeffrey Snyder, City Manager Discussed proposed property tax rate Public Comment: None Motion: Move to consider a proposed tax rate of $.82 for the FY 2022-2023 Budget and schedule the public hearing on the tax rate and budget for Tuesday, September 13th, 2022 at 7:00 p.m. at City Hall, 202 W. 5tn Street. An Ordinance of the City Council of the City of Plainview, Texas, Approving a Negotiated Settlement Between the Executive Committee of Cities Served By Atmos West Texas ("Cities") and Atmos Energy Corp., West Texas Division Regarding the Company's 2022 Rate Review Mechanism Filing; Declaring Existing Rates to be Unreasonable; Adopting Tariffs That Reflect Rate Adjustments Consistent with the Negotiated Settlement; Finding the Rates to be Set by the Attached Settlement Tariffs to be Just and Reasonable and in the Public Interest; Approving an Attachment Establishing a Benchmark for Pensions and Retiree Medical Benefits; Approving an Attachment Regarding Amortization of Regulatory Liability; Requiring the Company to Reimburse Cities' Reasonable Ratemaking Expenses; Determining that this Ordinance was Passed in Accordance with the Requirements of the Texas Open Meetings Act; Adopting a Savings Clause; Declaring an Effective Date; and Requiring Delivery of this Ordinance to the Company And The Cities' Legal Counsel. (Ordinance No. 22-3730 — First Reading) Presenter: Jeffrey Snyder, City Manager After a review of Cities' consultants' report and negotiations with Cities' Executive Committee, Atmos agreed to a rate increase of $6.76 million plus revenue related taxes. The impact of this increase in revenues to an average residential customer's bill is an increase of approximately $3.36 per month. A Resolution By the City of Plainview, Texas ("City") Denying Southwestern Public Service Company's Proposed Surcharge in Connection With Final Rates Approved Related to its Statement of Intent Submitted on About February 8, 2021; Authorizing the City's Continued Participation With Other Cities in the Alliance of Xcel Municipalities ("AXM") and Participation in Related Rate Proceedings; Authorizing the Hiring of Attorneys and Consultants; Requiring Reimbursement of Reasonable Legal and Consultant Expenses; Finding that the Meeting Complies With the Open Meetings Act, - Making Other Findings and Provisions Related to the Subject (Resolution R22-575) Presenter: Jeffrey Snyder, City Manager AXM's Special Counsel recommend that the City deny SPS' application for its proposed surcharge. Consider and take necessary action regarding Agreement for Professional Services between Parkhill, County of Hale and City of Plainview for Joint Crack Seal Project and Authorize Mayor to Sign Agreement Presenter: Jeffrey Snyder, City Manager This Agreement would authorize the professional services in the amount of $13,000 for runway crack seal project at the Plainview -Hale County Airport. This is a part of the ongoing runway preventative maintenance program. Consider and take necessary action regarding License Agreement for Running Water Draw Regional Park Softball Field between the City of Plainview and Wayland Baptist University Presenter: Jeffrey Snyder, City Manager Authorize Wayland Baptist University to use north softball field at Regional Park as a practice facility Public Comment: Dr. Claude Lusk Motion: Move to approve Item 9 Motion by Council Member Weiss, seconded by Council Member McDonough Vote: 8-0. Motion carried. 10. Consider and take necessary action on the petition requesting annexation from T&J Auto Inc. (James Odom) and Jack Rabbit Ranch LLC (Charles Schafer) of 8+/- acre tract or parcel of land out of a 20.0 acre tract of land being situated in Section 22, Block JK-2, G.C. & S.F.R.R. Co. Survey, Hale County Texas, as recorded in Volume 1031, page 1109, Deed Records of Hale County Texas and scheduling a public hearing accordingly. Presenter: Jeff Johnston, Assistant City Manager This annexation is tied to the construction of the Legacy Trails 40-unit senior living complex planned on Andy Taylor Road just north of Olton Road Public Comment: None Motion: Move to approve Item 10 Motion by Council Member House, seconded by Council Member Martinez Vote: 8-0. Motion carried. 11. Consider and take necessary action on a municipal services agreement between the City of Plainview and T&J Auto Inc. (James Odom) and Jack Rabbit Ranch LLC City Council Minutes August 23, 2022 Page 4 of 5 182 (Charles Schafer) for of 8+/- acre tract or parcel of land out of a 20.0 acre tract of land being situated in Section 22, Block JK-2, G.C. & S.F.R.R. Co. Survey, Hale County Texas, as recorded in Volume 1031, page 1109, Deed Records of Hale County Texas if annexed. Presenter: Jeff Johnston, Assistant City Manager This covers Municipal Service Agreement for annexation tied to construction of Legacy Trails.
