R83-605 A RESOLUTION DECLARING THE NEED TO SUBDIVIDE A CERTAIN TRACT OF LAND OI~ED BY THE CITY OF PLAINVIEW AND AUTttORIZING 7'HE b'~YOR AND CITY CLERK TO EXECUTE THE DEDICATION DEED FOR SUBDIVIDING SAID TRACT' OF LAND INTO PECOS ADDITION, PLAINVIEW, TEXAS. WHEREAS, the City of Plainview owns an 0.65 acre tract of land out of Section 26, Block JK-2, Hale County, Texas, the deed for which is recorded in Volume 696, Page 733, of the Hale County Deed Records; and WHEREAS, the City of Plainview needs to drill a water well upon said tract of land; and IFflEREAS, the Subdivision Regulations of the City of.Plainview require that land within the City Limits must be subdivided before being improved for uses other than agricultural uses; and WHEREAS, said tract of land lies within the City Limits of the City Of Plain- view and is therefore subject to said regulations; NOW THEREFORE BE IT RESOLVED by the Mayor and City Council of the City of Plainview that said tract of land be subdivided into three lots as shown on the Preliminary Plat of Pecos Addition, Plainview, Texas as previously approved by the Planning and ZoningCommission and CitY Council, both of the City of Plainview; AND THAT the Mayor and City Clerk be and are hereby authorized to execute the Dedication Deed for said Pecos Addition, Plainview, Texas, on behalf of the City of Plainview. DODSON, City Clerk DEDICATION DEED OF PECOS ADDITION, PLAINVIEW, TEXAS STATE OF TEXAS COUNTY OF }~LE WHEREAS, THE CITY OF PLAINVIEW, a Municipal Corporation of the State of Texas, is the sole owner of a certain tract of land lying and being situated in the City of Plainview, Hale County, Texas, described by metes and bounds as fo!lows~ to-wit: An 0.65 acre tract of land out of Section 26, Block JK-2, Hale County, Texas, conveyed from Jonnie B. Halbert, et al, to the City of Plainview by deed recorded in Vol. 696',.page 733, of the Hale County Deed Records} described as follows: CO~V~IENCING at the N.W. corner of Section. 26, Block JK-2, Hale County, Texas; THENCE S. 89° 59' 30" E., 1,826.9 feet along the North line of said Section 26, to the West rightzof-way line 'of State Highway No. 194; THENCE S. 61© 13' 54" E., 1,472.93 feet. along said ~ight-of-way line to a point; THENCE S. 28° 46* 06" W., at S10.0 feet, pass the N.W. corner of a 6. S acre tract, continuing along the West line of said 6.S acre tract and along the East line of a dedicated al~ey, at 1,679.6 feet, pass the S.W.-corner of said 6.5 acre tract, in all 1,699.6 feet to a 3/8 inch steel rod set 'in the south line of a dedicated-alley for the Northwest corner and POINT OF BEGINNING for this tract; THENCE S. 61° 13' 54" E., 200 feet alo.ng the South line of a dedicated alley to a 3/8 inch steel rod;- THENCE S. 16° 13" 54" E. 28.28 feet along the Southwest line of said dedicated alley to a 3/8 inch steel rod; THENCE S. 28° 46' 06" W., 110 feet along the West line of said dedicated alley to a 3/8 inch steel rod in the North right-of-way line of Highland Road in the City of Plainview, Texas; THENCE N. 61© 13' 54" W., 220 feet along the North right-of-way line of said Highland Road to a 3/8 inch steel rod; THENCE N. 28° 46' 06" E.,.130 feet to the POINT OF BEGINNING and contain- ing 0.65 acres of land. AND WHEREAS, the said City of Plainview has platted said prGperty into lots in accordance with the attached map prepared by William Russell Ho. gge, a Registered Public Surveyor of Texas, on the 22nd day of April, 1983; NOW, THEREFORE, in consideration of the benefit to the said City of Pl'ain- view, it does hereby dedicate the said lots shown on the attached map and does by these presents, impress the name of Pecos Addition, Plainview, Texas, upon said property for the correct description of lot numbers as indicated upon the attached map and does hereby attach the map ]lereto and impress the same upon said land, incorporating the said map hereto as a part of this dedicaiion.
