A RESOLUTION OF THE CITY COUNCIL OF PLAINVIEW, TEXAS
AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT ON
BEHALF OF THE CITY WITH ~S FEEDERS, INC. TO
SUPPLY ~ FROM THE CITY'S AT.rOCATION OF CANADIAN
RIVER k~TER A33THORITY TO CACTUS FEEDERS, INC. FEEDYARD.
WHEREAS, in 1977, the City of Plainview ente_r.ed into an agreement
with Foxley Cattle Co. to provide water frcm the City's Canadian River
Water allocation to the feedyard; and
WHEREAS, the transfer of ownership has presently been made from
Foxley Cattle Co. to Cactus Feeders, Inc. who will operate the feedyard
and desire to execute a new agreement for purchase of water; and
WHEREAS, this agreement contains emergency provisions, which in the
event that shortage of domestic, cc~nercial or industrial water for
distribution in the water system of the City of Plainview occurs,
delivery of water to Cactus Feeders, /nc. will be discontinued after a
24-hour notice by the City Council; and
WHEREAS, this agreement shall become effective September 1, 1983
and last for ten (10) years~ unless terminated by eithe~ party:
NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of the
City of Plainview, Texas that the Mayor be authorized to enter into said
agreement on behalf of the City to sell Canadian River Water to Cactus
Feeders, Inc. at 2 x the rate paid by the City, plus energy charges and
a surcharge assessed by Canadian River Municipal Water Authority.
