R83-660 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINIrlEW, TEXAS DESIGNATED AN AREA WITHIN THE PLA/NVIEW CITY PARK SYST~4 FOR THE RIDING, DRIVING OR OPERATING OF MOTORCYCLES OR MINI-BIKES. WItEREAS, the area originally designated for the operation and riding of motorcycles and minibikes within the Plainview City Park Syste~ has been closed to such activities due to the construction of Interstate 27 by the Texas Department of Highways and Public Transporta- tion and also due fro the park improvements being made in that area. Thsi area has become to hazardous to allow the continuation of the operation of motorcycles, minibikes and all other motor vehicles in this area, and is in the best interest, safety, and welfare of the citizens to now prohibit and make unlawful the operation of motorcycles, minibikes, and/or other motor vehicles in the area; and WHEREAS, being that there is a need for a designated open space within our conm~Lnity to facilitate and allow citizens to enjoy the riding and operating of motorcycles and mini-bikes; and WHEREAS, the City now designates another area within the park system to accommodate this interest; and WHEREAS, the City owns a tract of land known as the "old Lakeside Park location", which is the East one hundred seventy seven feet (E/177') of lot Two (2), Block No. Five (5) and all of Blocks Nine (9), Twelve (12), Sixteen (16) and Nineteen (19), Revised West Lynn Subdivi- sion of Blocks Nos. Thirty-one (31) , Thirty-two (32), Thirty-three (33), Thirty-nine (39) and parts of Blocks Nos. Thirty-eight (38), Forty (40), Forty-one (41) , Forty-two (42) ,and Forty-three (43) Lakeside Addition to the Town of Plainview, Hale County, Texas; and WHEREAS, a map of the designated motorcycle area will be on file in the offices of the City Clerk and motorcycles may be operated in the area confined to the red lines of said map and subject to the rules, regulations, and prohibitions hereinafter prescribed: 1) It shall be unlawful for any person to operate any motorcycle, mini-bikes, or motor vehicle in any this park unless there is a mnffler on the motorcycle or mini-bike sufficient to muffle the sound of the motor's propelling of the motorcycle or mini-bike and said muffler meets all the requirements of the State Law required of mufflers on such vehicles operated on a Highway or street within the State. 2) The Supervisor of Parks shall place signs designating the areas where motorcyles and mini-bikes can be operated and shall also place signs in other parts of the park to give notice to all persons that the operation of motorcycles and mini-bikes are prohibited except in special desigD~ted areas. Violation of this will constitute a vilolation of the City Ordinance, and violators shall be guilty of a misdemeanor upon convection thereof, and shall be punished be a fine not to exceed $200. NOW, THEREFORE BE it resolved by the Mayor and City Council of the City of Plainview, Texas that a portion of an area here above described and known as the "old Lakeside Park location" be designated to allow the operation of motorcycles and mini-bikes within the boundaries noted by the designated signs.
