(DOC) POTTS TO INSTALL DECORATIVE LIGHTING AND LANDSCAPING ON PUBLIC RIGh~-OF-~Y SURROUNDING THE P~ BANK PROPERTY AND PROVIDING FOR AN INSURANCE POLICY IND~IFYING AND HOLDING THE Ci~ffY HARMLESS OF ANY LIABILITY; AND AUTHORIZE THE CITY ATIORNEY TO pREPARE NECESSARY LEGAL DOCUMENTS. WHEREAS, the J.A. (Doc) Ports has requested that they be granted permission to install decorative lighting and landscaping on public right-of-way surrounding the perimeter of the bank property; and WHEREAS, these areas under consideration are fronting Fourth Street, 400 block of Baltimore and 400 block of Columbia Street; and WHEREAS, J.A. (Doc) Potts is requesting t_hat the City Council authorize the issuance of a street use permit and J.A. (Doc) Ports has agreed to indenmify and hold the City harmless of any liability incurred as results of installation of decorative lighting and landscaping: NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of the City of Plainview, Texas that: SECTION 1: That the J,A. (Doc) Ports be authorized to install decorative lighting and landscaping on public right- of-way surrounding the perimeter of the bank property fronting the following streets; Fourth Street, 400 block of Baltimore, and Columbia; SECTION 2: That the J.A. (Doc) Ports be issued a street use permit and furnish the City of Plainview on a yearly basis a certificate showing that they have enforced (and shall keep enforced at all times) a policy of liability insurance with an insurance cc~pany authorized to do business in the State of Texas in the amount of not less than $300,000 with the City of Plainview being named as additional insured as protection frc~ any liability during, after or as results of said construction and the same shall, in additional to be protecting the owner, provide therein that it will also protect the City. S~CTION 3: That the City Attorney be authorized to prepare the necessary legal documents to effectuate this resolution. PASSED AND APPROVED this the 8th day of May_, ~I~LTER S.
