A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF P~,
TEXAS EXTENDING THE T/ME FOR CONSIDERATION OF THE ENERGAS
CC~PANY RATE INCREASE AS PER~iE%~fED BY STATE LAW.
WHEREAS, the Governing Body of the City of Plainview, Texas is the
local regulatory authority for gas utility rate matters within its
jurisdiction; and
WHEREAS, on the 6th day of July, 1984, Energas ~any did file a
Statement of Intent with the Municipality of Plainview, Texas to
increase natural gas rates to certain classes of customers residing
within said municipality; and
WHEREAS, said Statement of Intent proposes an effective date of
August 10, 1984 for such increase in natural gas rates; and
WHEREAS, the Governing Body of the Municipality of Plainview, Texas
wishes to insure that it has sufficient time to study the rate req~_est
of Energas Company; and
WHEREAS, state law permits the Governing Body of the Municipality
of Plainview, Texas to suspend the effective date of any proposed
increase in gas utility rates within its original jurisdiction.
NOW, THEREFORE, BE IT RESOLVED BY the City of Plainview, Texas:
That the proposed increase in natural gas rates contained in the
Statement of Intent of Energas Cc~pany, as filed with the City of
Plainview, Texas on July 6, 1984 be and the same is hereby SUSPENDED for
such period of time, consistent with Section 43 (d) of Art. 1446c,
Vernon's Texas Civil Statutes, as is required for the City of Plainview,
Texas to study and act upon such rate increase request; and
That a copy of this Resolution shall be delivered forthwith to Energas
Company.
Duly adopted this 24th of July, 1984 in regular session of the
Governing Body of the City of Plainview, Texas.
