A RESOLUTION OF THE CITY OF PLAINVIEW AUTHORIZING TtIE
CITY TO PURCHASE A CHILDERS MODEL EA-150 CIRCULATING OIL
HEATER~
WHEREAS, the City of Plainview was the owner of a Childers
Model EA-150 circulating oil heater; and
WHEREAS, as a result of an electrical malfunction in the
equipment, the heater caught on fire and burned, destroying the
heater; and
WHEREAS, at the time of the destruction of the heater, the
City of Plainview was in the process of completing its paving seal
coat program for the year; which program was interrupted because of
destruction of the heater; and
~¢HEREAS, the heater was insured against loss for the replace
cost less $1,000.00 deductible; and
WHEREAS, the insurance company has notified the City of
Plainview that the loss of the oil heater is insured under the
terms of the policy for the replacement cost; and
WHEREAS, there is an immediate need to purchase a replace
circulating oil heaner for the purpose of completing the street
seal coating program before the beginning of inclement weather; and
WHEREAS, the City Council has determined that an emergency
exists and there is a necessity to purchase the circulating oil
heater to complete the seal coat program for the purpose of pre-
venting damage to the streets of the City of Plainview.
NOW THEREFORE, BE IT RESOLV '

BE IT FURTHER RESOLVED that the City Council authorizes,
ratifies and confirms the purchase of said Childers Model Es-150
circulating oil heater to replace the oil heater which was de-
stroyed.
