HomeMy WebLinkAbout23-3746 Ordinance206 ORDINANCE NO. 23-3746 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF PLAINVIEW, TEXAS BY AMENDING THE FEES, RATES AND SERVICE CHARGES FOR PROVIDING MUNICIPAL AND GOVERNMENTAL SERVICES INCLUDING THOSE FEES, RATES AND SERVICE CHARGES FOUND IN CHAPTER 1 "ADMINISTRATION", CHAPTER 2 "ANIMAL CONTROL", CHAPTER 3 "BUILDING REGULATIONS", CHAPTER 4 "BUILDING REGULATIONS", CHAPTER 6 "HEALTH AND SANITATION", CHAPTER 7 "MUNICIPAL COURT", CHAPTER 8 "OFFENSES AND NUISANCES", CHAPTER 12 "TRAFFIC AND VEHICLES", CHAPTER 13 "UTILITIES" AND CHAPTER 14 "ZONING"; CREATING APPENDIX C "MASTER FEE SCHEDULE"; PROVIDING FOR A PENALTY NOT TO EXCEED $500.00 FOR EACH OFFENSE; PROVIDING AN EFFECTIVE DATE; PROVIDING A SAVINGS CLAUSE; PROVIDING A REPEALER AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council for the City of Plainview, Texas pursuant to the constitution and laws of the State of Texas including, but not limited to, Article 11, Section 5 of the Texas Constitution as a home rule city, Title 7, Subtitle A and Chapters 51 and 552 of the Texas Local Government Code, Chapters 363 and 364 of the Texas Health and Safety Code, and Article II, Section 2.12 of the City of Plainview City Charter, authorizes the City to impose and set fees and rates for providing various city services for the benefit of the citizens of the City of Plainview; and WHEREAS, a home rule city's authority to enact ordinances under its police power carries with it the corresponding right to impose fees to fund and implement such ordinances and such fees are presumed valid if they are reasonably associated with the cost of administering the ordinance; and WHEREAS, the Article II, § 2.12(10) of the City Charter of the City of Plainview requires the City Council to set the rate for services, fees or licenses provided by the City of Plainview by ordinance; and WHEREAS, the City Council of the City of Plainview previously adopted rates, fees and service charges for providing a variety of municipal governmental services as codified throughout the Plainview Code of Ordinances reasonably associated with the cost of providing such municipal services; and WHEREAS, the City Council has found that, due to the increase in expenses associated with providing such municipal services it has become necessary to amend certain fees, rates and service charges; and WHEREAS, in order to promote certain efficiencies and eliminate waste of public resources and to simplify the ability of the public to see what fees, rates and service charges are imposed by the City of Plainview for providing municipal and governmental services, the City Council believes it would be in the best interest of the City of Plainview to consolidate all such fees, rates and service charges into a master fee schedule; and WHEREAS, the City Council of the City of Plainview further finds that amending the fees, rates and service charges imposed by the City of Plainview to help recover the expenses associated with providing such municipal and governmental services and adopting the master fee schedule as outlined herein operating and maintaining the City's utilities and provide certain governmental services and to promote efficiencies, transparency and eliminate waste is reasonable and necessary and is in the best interest of the public health, safety and welfare; Master Fee Schedule Ordinance Page 1 of 29 207 NOW THEREFORE, THE CITY OF PLAINVIEW HEREBY ORDAINS THAT: SECTION 1. The Code of Ordinances, City of Plainview, is hereby amended by amending the rates, fees and service charges for providing the following municipal and governmental services as follows (for reference purposes, new additions to the Code of Ordinances are underlined and italicized and deleted provisions are indicated by strikethrough text and [bracketed] information is for informational purposes only): CHAPTER 1 GENERAL PROVISIONS ARTICLE 1.02 ADMINISTRATION § 1.02.001 Fee for copies of police reports. For furnishing a copy of a police report, accident report or any other report made or kept by the police department of the city there shall be charged and collected a fee as provided for in the Master Fee Schedule ARTICLE 1.12 LIBRARY § 1.12.003 Fees. ARTICLE 1.13 PARKS AND RECREATION § 1.13.002 Fees and charges. (a) The fees and charges to be imposed by the city for the use of the Broadway Shelter House, Regional Park Rotary Building and Joliet Street Community Center when used for the special benefit of the user shall be as set forth in the Master Fee Schedule Ordinance Page 2 of 29 Master Fee Schedul . § 1.13.094 Issuance of permit. (b) All irrigators or irrigation technicians must hold a valid state license, register with the city, pay an annual city registration fee as set forth in the Master Fee Schedule , and provide either a surety bond in the amount of ten thousand and no/100 dollars ($10,000.00) or general liability insurance in the amount of three hundred thousand and no/100 dollars ($300,000.00). § 3.05.217 Matters not covered; fees. The city council may create a schedule of fees for obtaining and renewing an irrigation permit. These fees will be in amounts sufficient to cover the city's costs in issuing and renewing the permits, including, but not limited to, staff time and other overhead costs. This schedule is included in the Master Fee Schedule. sest+ea ARTICLE 3.06 MECHANICAL WORK § 3.06.091 Requirements. All licensed air conditioning and refrigeration contractors and companies shall register with the code enforcement department. A copy of the certificate of insurance as indicated below must be provided along with a copy of the contractor license and driver's license of each contractor. An annual registration fee as set forth in the Master Fee Schedule of $30.00 shall be paid at the time of registration. Contractors and companies may also be required to pay an inspection fee as set forth in the Master Fee Schedule Ordinance Page 7 of 29 213 Master Fee Schedule for new construction, additions to existing buildings or structures or when necessary for the change out of air conditioninq and refrigeration units. ARTICLE 3.14 PUBLIC RIGHT-OF-WAY § 3.14.124 License required; conditions. The following shall control the consideration of requests for encumbrances on, over, under, or through public rights -of -way: (1) The right to encumber the public right-of-way may be granted only by license and every grantee of a license shall agree to indemnify and hold the city harmless from any and all damages to persons or property, or both, arising in any manner out of the use of the licensed premises. Each applicant for a license shall submit a nonrefundable deposit as set forth in the Master Fee Schedule e€ two to cover the expenses of the processing costs associated therewith. The total deposit shall be credited toward the issuance of the first -year license fee, should the applicant be approved for a license. The application must be accompanied by plans or drawings showing the area to be used and a statement of the purpose for which the right-of-way is to be used. The applicant is responsible for the establishment of the fair market value in the area of consideration for license. Fair market value shall be established by a competent appraiser and in accordance with customary practices in real estate appraisal. (2) No individual, person, firm, or corporation shall be granted a license for an encumbrance of the public right-of-way that would adversely affect the public health, safety, or welfare of the citizens of the city. (3) Subject to the exemptions set forth in section 3.14.125, no license shall be issued or granted for an encumbrance of the public right-of-way for less than a three- foot width. (4) Subject to the exemptions set forth in section 3.14.125, a licensee shall pay a license fee depending upon the amount of right-of-way encumbered asset eet belowasset forth in the Master Fee Schedule. (a) Any applicant who wishes to encumber public rights -of -way for installation of a private water line with a diameter of one inch (1") or less and for a distance of not more than three hundred feet (300'), a private sewer line with a diameter of four inches (4") or less and for a distance of not more than three hundred feet (300'), and an overhead line for a distance of not more than three hundred feet (300'), or for an encroachment by a building, is hereby exempt from the annual license fee and shall be subject to a one-time license fee as set forth in the Master Fee Schedulee#fi#tdollars (b) An applicant who wishes to encumber the public right-of-way adjacent to the applicant's private property for the purpose of installation of a private lawn sprinkler or irrigation system is hereby exempt from the license fee requirements of this division. CHAPTER 4 BUSINESS REGULATIONS ARTICLE 4.03 ALCOHOLIC BEVERAGES § 4.03.007 License and permit fees. (c) Code enforcement shall notify the state liquor control board of any person failing or refusing to pay the license fee and request cancellation of the license of such person in accordance with Texas Alcoholic Beverage Code Ann., sestiee§ 61.36 (VeFfR'S 2007- . ARTICLE 4.05 JUNK DEALERS § 4.05.036 Fee. Each junk dealer shall pay an annual license fee, to be set by resolution of the city council, for each license issued under this division. ARTICLE 4.06 MASSAGE ESTABLISHMENTS § 4.06.035 Fee. The annual permit fee shall be set for in the Master Fee Schedule dollars ($100.00) for each such establishment. If the permit is obtained between January 1 and June 30 of any year, the full amount of such fees shall be paid. If such Master Fee Schedule Ordinance Page 9 of 29 215 permit is obtained between July 1 and December 31 of any year, the fee shall be one-half (1/2) of such amount. No refund shall ever be made of any such permitfees. ARTICLE 4.07 PEDDLERS, ITINERANT VENDORS AND SOLICITORS LICENSE § 4.07.031 Required; issuance; fees; renewal. (f) Fees. Each application for an itinerant vendor's license shall be accompanied by a license fee as set forth in the Master Fee Schedule for the applicant and for each employee, agent, or representative of the applicant vendor who will sell, offer, exhibit, or solicit orders for the sale of goods, wares, or merchandise for or on behalf of the applicant vendor. 0) Renewal application and fees. Each renewal application shall be accompanied by a license renewal fee as set forth in the Master Fee Schedule of for each applicant vendor and aR additional teR dollars ($10.00) for each employee, agent, or representative selling, offering, exhibiting or soliciting orders for the sale of goods on behalf of the applicant vendor. [The remainder of §4.07.091 not specifically amended as above remains the same] ARTICLE 4.08 SEXUALLY ORIENTED BUSINESSES § 4.08.020 License and permit fees. (a) An original application for a sexually oriented business license shall be accompanied by a nonrefundable application fee as set forth in the Master Fee Schedule . The license fee will be refunded if the license is denied. An application for renewal shall be accompanied by the amount of the license fee. (b) An application for issuance or renewal of an adult service provider permit shall be accompanied by a nonrefundable fee as set forth in the Master Fee Schedule. (c) An application for issuance or renewal of a sexually oriented business manager permit shall be accompanied by a nonrefundable fee as set forth in the Master Fee Schedule (d) A duplicate or certified copy of a license, permit or identification card shall be issued by the director upon payment of a fee as set forth in the Master Fee Schedule. . (e) A fee as set forth in the Master Fee Schedule shall be paid at the time of fingerprinting for each set of fingerprints to be provided for by the chief under section 4.08.006. ARTICLE 4.09 TAXICABS § 4.09.035 Fee. Before any permit shall be issued under the provisions of this article, the applicant shall pay an annual fee as set forth in the Master Fee Schedule deltaF6 ($100). ARTICLE 4.11 ALARM SYSTEMS Master Fee Schedule Ordinance Page 10 of 29 216 § 4.11.004 Police department monitoring fee. There shall be assessed against each alarm company, agency or system which is to be monitored at the police department a fee as set forth in the Master Fee Schedule for each alarm device installed at the police department. § 4.11.032 Fee; duration. A nonrefundable fee as set forth in the Master Fee Schedule of $10.00-is required for each permit or renewal of a permit. A permit shall be issued for two years and shall be renewed every two years thereafter by payment of the permit fee. It is the responsibility of the permit holder to pay the renewal fee prior to the expiration date of the permit. § 4.11.033 False alarm fees; revocation of permit for excessive false alarms. (a) The holder of a burglar alarm permit shall be allowed six (6) false alarms. After that a $25.00 fee as set forth in the Master Fee Schedule shall be assessed for each additional false alarm up to 12 in one year. If the false alarms exceed twelve, the permit may be revoked until proof is shown that the alarm has been repaired or the problem is solved. (b) The permit holder of a fire alarm shall be allowed six (6) false alarms. After that a $25.00 fee as set forth in the Master Fee Schedule shall be assessed for each additional false alarm up to 12 in any one year. If the false alarms exceed twelve, the permit may be revoked until proof is shown that the alarm has been repaired or the problem is solved. (c) The holder of a robbery alarm permit shall be allowed six (6) false alarms. After that a $26.50 fee as set forth in the Master Fee Schedule will be assessed for each additional false alarm up to twelve (12) in any one year. If the false alarms exceed twelve, the permit may be revoked until proof is shown that the alarm has been repaired or the problem is solved. (d) The permit holder of an emergency assistance alarm shall be allowed six (6) false alarms. After that a fee as set forth in the Master Fee Schedule of $10.00 will be assessed for each additional false alarm. The permit may be revoked if the false alarms exceed 12 in any one year until proof is shown that the alarm has been repaired or the problem is solved. (e) The permit holder of a medical assistance alarm shall be allowed six (6) false alarms. After that a fee as set forth in the Master Fee Schedule of $10.00 will be assessed for each additional false alarm up to 12. If the false alarms exceed 12 in any one year, the permit may be revoked until proof is shown that the alarm has been repaired. (f) A permit holder shall pay any service fee assessed under the provisions of this section within 30 days after receipt of notice that it has been assessed by the coordinator. ARTICLE 4.12 FILM PRODUCTION § 4.12.004 Application procedure. (d) Application fee. An application -processing fee as set forth in the Master Fee Schedule e#-$26.00 shall be required for each application for film production in the city. The city manager may waive this fee for purely charitable, nonprofit or Master Fee Schedule Ordinance Page 11 of 29 217 educational institutions or projects. Depending upon the extent of the use of city property, the applicant agrees to reimburse the city for inconveniences when using public property. The Master Fee Schedule table belewoutlines the normal and customary fees for the activities described. However, in addition to the authority given the city manager elsewhere in this article, depending on special circumstances including but not limited to the size of the film production, the city manager has the authority to increase or decrease the costs outlined in the Master Fee Schedule table belewf by as much as fifty percent (50%) without further action being taken by the city council. No license shall be issued until: (1) Verification that the state occupation tax has been paid for each amusement redemption machine within the premises as required under the Texas Occupations Code Chapter 2153; (2) The annual license fee of $500.00 fee of the Gity as set forth in the Master Fee Schedule has been paid; and (3) A tax permit issued by the state and all seals required by the state are securely affixed to each amusement redemption machine. [The remainder of § 4.13.002 not specifically amended as above remains the same] Sec. 4.13.006 Renewal of amusement redemption machine game room license (a) A license may be renewed for the following calendar year beginning October 1st of each year by filing a completed application for each license and paying the Master Fee Schedule Ordinance Page 12 of 29 218 applicable fee set forth in this aO'Gle the Master Fee Schedule. A renewal application shall be subject to the same requirements in this section as for a license application. [The remainder of § 4.13.006 not specifically amended as above remains the same] Sec. 4.13.011 Inspections (c) The city shall have the authority to seal any amusement redemption machine located in any amusement redemption machine game room for which the state occupation tax has not been paid. A fee as provided for in the Master Fee Schedule will be charged for the release of any machine sealed for nonpayment of said occupation tax. [The remainder of § 4.13.011 not specifically amended as above remains the same] CHAPTER 6 HEALTH AND SANITATION ARTICLE 6.03 FOOD AND FOOD HANDLERS § 6.03.066 Permit fees. See Master Fee -. .. .. (b) The fee for food sellers who come under this section shall be as set forth in the Master Fee Schedule for those sellers who operate full time, year-round. The permit fee for those sellers who operate on a seasonal basis, that is, in operation from six months to two weeks out of the calendar year, shall be as set forth in the Master Fee Schedule. . Every applicant for a transfer ambulance operator's permit shall pay to the city the following nonrefundable fees upon the filing of the application with the city secretary as set forth in the Master Fee Schedule.: (1) An annual permit fee date of a permit. This fee may be waived by the city manager or his/her designee upon review. CHAPTER 7 MUNICIPAL COURT ARTICLE 7.04 FEES § 7.04.001 Special expenses. (a) All special expenses described in article 45.203, Code of Criminal Procedure, as amended, dealing with special expenses for the issuance and service of a warrant of arrest for an offense under article 38.10 of the Penal Code, or under section 543.009 of the Transportation Code, after due notice, not to exceed as set forth in the Master Fee Schedule , shall be paid into the city treasury for the use and benefit of the city. (b) All special expenses described in article 45.0511, Code of Criminal Procedure, as amended, dealing with the dismissal of certain misdemeanor charges upon completing a driving safety course, as set forth in the Master Fee Schedule net shall be paid into the city treasury for the use and benefit of the city. § 7.04.002 Building security fund. (a) A defendant convicted of a misdemeanor offense in a municipal court shall be required to pay a fee as set forth in the Master Fee Schedule as a cost of court. In addition, a fee as set forth in the Master Fee Schedule is hereby assessed for making a service call for the purpose of cutting off service for failure on the part of the consumer to pay water or sewer service or installment charges or for the purpose of collecting a delinquent account or for both if both purposes are accomplished in one service call. Until the account at the premises where service is cut off is paid in full or until the consumer or his agent has made arrangements satisfactory with the director of finance to pay such amounts, such service shall remain cut off. § 13.02.007 Collection fee for bad checks. (a) The city shall charge and collect for the depositing and disposal of accepted municipal solid waste, as defined in chapter 330 and chapter 335 of the Texas Administrative Code, as amended, into the city's type I sanitary landfill located east of the city on U.S. 70, by individuals, companies, corporations or governments. (b) (1) The charges shall be collected for each vehicle or hauling unit carrying municipal solid waste into the landfill for disposal. The charges shall be as set forth in the Master Fee Schedule: (2) Residents of the city who haul their own solid waste to the landfill will be permitted to deposit and dispose of their solid waste into the landfill without charge, provided the person making the delivery to the landfill has with him/her, at the time of entry, identification showing that he/she resides in the city and the customer's portion of the current or previous month's statement for water, sewer and sanitation services [and provides such information] to the landfill gate attendant at the time of entry. Residents without such identification and statement shall be required to pay the scheduled charge prior to exiting the landfill unless prior alternative billing arrangements have been made with the city finance department. Only persons hauling from their own residences shall be exempt from charges. The exemption does not apply to roofing materials or construction/demolition wastes resulting from activities by or on behalf of a resident. All contractors, yard maintenance persons and all others hauling municipal solid waste shall be charged and shall pay the scheduled charge upon exiting the landfill unless prior alternative billing arrangements have been made with the city finance department. (c) (1) The city shall charge and collect for depositing and disposal into the old landfill (Baker Pit) located at 300 Joliet Street, by individuals, companies, corporations or governments, of accepted inert materials as defined in chapter 330 of the Texas Administrative Code, as amended. Collection of the charges for depositing and disposing of inert materials into the landfill shall be made at the landfill gatehouse to the city landfill attendant for each delivery of inert materials as the vehicle or hauling unit enters the landfill unless prior alternative billing arrangements have been made with the city finance department. The charges shall be made based upon the type and size of the vehicle or hauling unit, regardless of the amount of inert material being hauled.
