A RESOLUTION OF THE CITY OF PLAINVIEW APPROVING A JUDG-
MENT REMOVING CLOUD ON TITLE TO A 7.86 ACRE TRACT OF LAND
OUT OF SURVEY 41, BLOCK JK-2 HALE COUNTY, TEXAS, OWNED
By VIRGINIA GRACE FRAZIOR. '
WHEREAS, Virginia Grace Frazior is the owner of a 7.86 acre
tract of land out of Survey No. 41, Block JK-2 Hale County, Texas
described by metes and bounds herein; and ' ,

the purpose of removing cloud on title to the 7°86 acre tract of

land described herein; and
WHEREAS, title to said 7.86 acre tract of land and onsite
inspection of the property reflects that Virginia Grace Frazior and
her predecessors in title were owners of said 7 86 acre tract for a
period in excess of twenty-five (25) years prior to the time that
the City of Plainview, Texas and Hale County, Texas purchased a
block of land which included the 7 86 acre tract described herein;
and .
WHEREAS, Virginia Grace Frazior is the true and rightful owner
to said property and judgment should be entered awarding said 7.86
acre tract of land to her.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Plainview, Texas, that the City Attorney ac ·

being in the middle of county roads going north, east and

THENCE N, 88o56, E., 125.83 feet to an iron rod in the
middle of county roads going south, east and west;
THENCE S. i°18,42', E., 2,623 05 feet along a county road
to a steel rod; '
THENCE S. 88o43,W., 135.09 feet to a point in the east
line of said Survey No
THENCE N. l°06,34,, W.,' 32;
2,623.54 feet along the east line
of Said Survey No. 32, to the POINT OF BEGINNING and
containing 7.87 acres.

JUDGMENT
On the day of , 1984, this cause came.on
for trial before the undersigned judge, with JACK O. NELSON appear-
ing as attorney for Plaintiff, and Defendants having filed dis-
claimers as to the ownership of the land in question made no
further appearance in said case. The Court, ~after examining the
pleadings, hearing the evidence, and noting the arguments of
counsel, is of the opinion that Plaintiff should recover from
Defendants the lands and premises in controversy.
It is therefore ordered by this Court that Plaintiff recover
from Defendants the title to and possession of the following
described property situated in the County of Hale, Texas:
A 7.86 acre tract out of Survey No. 41, Block JK-2, Hale
County, Texas:
BEGINNING at the N.E. corner of Survey No. 32, and the
N.W. corner of Survey No. 41, Block JK-2, said corner
being in the middle of county roads going north, east and
west;
THENCE N. 88°56' E., 125.83 feet to an iron rod in the
middle of county roads going south, east and west;
THENCE S. l°18'42'' E., 2,623.05 feet along a county road
to a steel rod;
THENCE S. 88°43'W., 135.09 feet to a point in the east
line of said Survey No. 32;
THENCE N. l°06'34'' W., 2,623.54 feet along the east line
of said Survey No. 32, to the POINT OF BEGINNING and
containing 7.87 acres.
It is further ordered that Plaintiff may have her writ of pos-
session and it appearing to the Court that all costs have been
paid, no provision for the recovery of costs is entered herein.
