R86-976 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS ESTABLISHING PLAINVIEW'S TEEN COURT; AUTHORIZING THE CITY MANAGER TO OBTAIN THE PROFESSIONAL SERVICES OF A COURT COORDINATOR; AND APPOINTING A TEEN COURT COMMITTEE AND ESTABLISHING THE POLICIES, GUIDELINES AND OPERATING PROCEDURES FOR THE TEEN COURT. WHEREAS, a Teen Court will reduce court time spent on hearing juvenile cases; and WHEREAS, a Teen Court will accept restitution in the form of community service; and WHEREAS, a Teen Court will provide a means for young offenders to become productive citizens. NOW THEREFORE BE IT RESOLVED by the Mayor and the City Council of Plainview, Texas ; Section 1. That the City hereby approves and establishes a Teen Court to be effective as soon as the necessary facilities, personnel, operating procedures and policies be established. Section 2. That the City Manager is authorized to provide for the duties and compensation of a Court Coordinator. Any necessary supplies or other offices for said Court Coordinator to be furnished by the Department of Municipal Court of the City. Section 3. That there is appointed a committee which shall be composed of the Municipal Judge; Teen Court Coordinator; a member of the City Council; the City Manager; a representative of the Plainview Police Department; and such other citizens as the City Mayor from time to time designate which shall establish policies, procedures and operations of the Teen Court and guidelines for referrals and sentences, role and authority of teen jurors, programs operating procedures, and design of forms and documents. This committee shall also select and appoint one or more qualified individuals to 'serve as Judge of the Teen Court who shall preside over all trials and preform all duties reasonably'incident thereto. Plainview Teen Court is a different way of dealing-with youths who are accused of an offense. You will present yourself to a Teen Jury, present your case,-and that jury will decide your punishment. The Jury may require you to do certain things, such as service for the community (4-30 hours), attend counseling sessions, or pay the victim a certain amount of money for the damages you did when you committed the offense (restitution), but you cannot be sent to detention. You may also be required to sit on the jury (1 or 2 times). If you opt for and complete the Teen Court Program, there will be no record of your having committed any offense. You have the right to talk' to a lawyer about whether you should take part in Plainview Teen Court or if you should go to the Municipal..~Court. You do not have to go to Teen Court, this is just an option to you. If you do decide to go to Teen Court (after your plea of guilty to the judge), you still have ten days after your plea to appeal to County Court. Once you decide to go to Teen Court and go to trial, if you do not like the punishment the jury sets for you, the only option you-then have is to go back to Municipal Court and pay a fine. Defensive Driving is no longer an option to you. If, at any time during the course of working off your service hours, you have decided you no longer want to participate in Teen Court, you then may only pay your fine. This program is set up to help keep young peoples' records clear and give our youth an opportunity to have the self- satisfaction of contributing to our community through volunteer service work. If you decide to go to Teen Court, you and a parent/guardian must set up a time to see the Coordinator, fill out some papers, and get all the information on Teen Court.
