RESOLUTION NO. R86-104
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAIATv~EW,
TEXAS AUTHORIZING THE CITY MANAGER, ON BEHALF OF THE CITY
OF PLAINVIEW, TO ENTER INTO A LEASE AGREEMENT WITH THE
PLAINVIEW INDEPENDENT SCHOOL DISTRICT FOR THE USE OF THE
JAYCEE ~E]~LAT,T, FIm~.D LOCATED IN THE BROAD~AY STREET PARK.
WHEREAS, the City of Plainview (City) and the Plainview Independent
School District (PISD) entered a Lease Agreement for the use of the
Jaycee Ballpark on November 27, 1979; and
WHEREA~, said Lease Agreement expired on May 31, 1984; and
WHEREAS, it is in the best interest of the taxpayers of the City
and PISD that the two entities share facilities where possible in order
to reduce total operating cost; and
WHEREAS, the City Manager has been negotiating with PISD Officials
for the renewal of the lease and has reached a consensus on the
following items:
1) The School is to provide maintenance personnel for the facility
frcm December 1, to May 31 annually, including placing the electric
meter for the baseball field in the name of the school.
2) The School assumes the responsibility to prepare the baseball
field and accompanying facilities for use each spring.
3) The School will be responsible for applying the necessary
herbicide to control unwanted weeds in the facility. The required
fertilization of the entire field is to be accomplished by the School
between mid January andmid February.
4) The School will provide, on an alternating basis, the labor to
repair and paint the stadium bleachers, concession stand, restroom
facilities, announcer's booth and related facilities.
5) The School is to be totally responsible for the maintenance and
upkeep of the facility to the School's standards including all watering
of the facility.
6) All cost for material and contract labor will be split 50/50 by
the City and School.
WHEREAS, the City recognizes that additional negotiations rmast
occur before a final contract maybe developed.
NOW, THEREFORE BE IT RESOLVED by the City Council that the City
Manager is hereby authorized to negotiate a lease agreement with PISD as
it pertains to the use of the Jaycee Baseball Field.

BE IT FURTHER RESOLVED, that the final lease agreement may be
executed by the City Manager on behalf of the City of Plainview.
