RESOLUTION NO. R87-205
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS AUTHORIZING THE EXPENDITURE
OF FUNDS FROM THE CITY OF PLAINVIEW HOTEL/MOTEL
TAX RESERVE FUNDFOR REPAIRS OF THE PLAINVIEW
CHAMBER OFCOMMERCE PARKING LOT.
WHEREAS, the parking lot of the City owned facilities utilized
the Plainview Chamber of Commerce was in need of repair; and
by
WHEREAS, the repairs to said parking lot have been completed at
total expense of $10,298.00; and
WHEREAS, the meeting room in the Chamber of Commerce facilities is
recognized as an Official Civic Center Facility of the City of
Plainview; and
WHEREAS, the Chamber of Commerce, through its Tourism and
Convention Committee, is recognized by the City of Plainview as the
official organization designated to promote tourism and conventions
for the City of Plainview; and
WHEREAS, the Chamber of Commerce Tourism and Convention
has reviewed said expenses and is recommending that the
Plainview pay one-half of said cost.

NOW THEREFORE BE IT RESOLVED by the Mayor and the City Council of
the City of Plainview, Texas, that $5,149.00
be allocated from the City of Plainview HOTEL/MOTEL TAX RESERVE FUND
to the Chamber of Commerce in order to reimburse the Chamber for a
portion of the cost associated with repaving and concrete work around
the Chamber Offices.

Dear Mr. Tawwater:
It has been brought to the attention of TH&MA'that.the PIainview Chamber of
Commerce is about to use $4,000 of revenues collected-via the City room tax
for the purpose of repaying the pa~king lot at the chamber of commerce
building.
If this information is correct,'TH&MA,.on behalf of it's hotel members in
your city, strenuously objects to the use of room tax revenues for this
purpose. Even the most liberal construction of the statute wouJd not aJIow
for such an'expenditure.

and attorney general's opinions of the.recent past would agree that this
spending is not legal under the statute, the chamber is encouraged to find
alternate revenues for the resurfacing of the parking lot.
TH&MA does not Wish to be contentious 'in it's desire to assist its-members
in PIainview, but rather, is most desirous of insuring that revenues col-
lected under the statute are "expended in a manner directly enhancing and
promoting tourism.and the convention and hotel' industry.,,
It is my understanding that the hoteIiers in Plain.view are prepared to enter
litigation to insure that the chamber complies witN the statute. If the
facts are consistent with the narrative we have received, TH&MA would
reluctantly,-but enthusiastically, join in this action.
It is hoped that members of thechamber will defer action on this budget
allocation at their meeting on 'Wednesday,. January,7,
