A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS ADOPTING A GENERAL PAVING POLICY FOR THE
THE CITY OF PLAINVIEW AND REPEALING ANY PRIOR
POLICY IN CONFLICT HEREWITH.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS:
SECTION 1. That the following statements are hereby adopted as
a General Paving Policy for the City of Plainview and any previously
adopted policy in conflict herewith is hereby repealed:
I. General Provisions.
A. For the purposes of this policy, the term paving shall
include the roadway paving and concrete curb and gutter
and accompanying drainage structures, as applicable.
B. Paving shall be constructed in accordance with plans and
specifications expressly approved by the Department of
Engineering of the City of Plainview.
C. On paving projects initiated by the City of Plainview the
costs of adjustment of existing private drives to the
new curb and gutter will be borne by the City. Where,
because of the paving construction, it is necessary to
remove such improvements as sidewalks and retaining
walls, the City will bear the expense of replacement of
such improvements-
On paving projects initiated by private landowners
and/or developers, such costs shall be borne by said
landowners and/or developers at no cost to the City of
Plainview.
D. The property owner shall be responsible for removal from
the construction area (within the street right-of-way)
of any of his improvements, such as fences, trees,
shrubs, and sprinkler systems, which he wishes to
salvage. His failure to do so before construction
begins will constitute permission for the contractor to
remove and dispose of the improvements-
E. The Department o.f Engineering will be in charge of field
engineering and inspection on all paving projects.

F. Except as in Item V-D below, paving costs shall include
the cost of any required sub-base and base stabilization.
G. Street paving shall include concrete curb and gutter
unless otherwise specifically approved by the City
Manager-
H. Street paving widths'shall comply with those widths
established by the Department of Engineering of the
City of Plainview.
I. Characterization of residential or commercial property
for purposes of establishing street paving cost
participation will be determined by the planned future
use of the abutting property.
J. All alley and street paving projects must tie into
existing paving at one end.
Private Paving Contracts.
A. Prior to construction of a private paving project, a
private paving agreement with the City of Plainview
must be executed.
B There will be no City cost participation in private
paving contractS for public streets or alleys.
Residential Paving.
A. The cost of paving forty-one feet (41') or less width
streets adjacent to low density residential property
shall be paid by the adjacent property owner and/or
deVeloper.
B. If the City requires paving wider than forty-one feet
(41') adjacent to a low denSity residential use, the
cost for any additional width of paving will be paid by
the City except as noted in Item C below.
C. Forty-five feet (45') width paving may be required
adjacent to allowed high density uses in residential
areas. The cost of such paving shall be borne by such
high density use adjacent property owners, and/or
developers. For low density residential properties
across the street from such high-density uses, the
difference in cost between a forty-one feet (41') and a
forty-five feet (45') width street shall be paid by the
owner and/or developer of the high density use.
D. The initiator of the paving project shall pay the cost
of any necessary adjustment of an existing paved
intersection to conform to a proposed street width or
grade.

On iow density residential properties with double
frontage, that is, having frontage on a street as well
as having a rear property line on a street, the paving
cost for the street along the back of the property will
be fifty percent (50%) of~ the normal cost in Item III-A
above.

Commercial Area Paving.
The cost of paving forty-five feet (45') or less width
streets adjacent to townhouses, multiple-family,
commercial, industrial or institutional property shall
be borne by the adjacent property owners and/or
developers.
If the City requires that the paving be wider than
forty-five feet (45'), the cost for the additional
paving width will be borne by the City.
C. The initiator of the paving project Shall pay the cost
of any necessary adjustment of an existing paved
intersection to conform to a proposed street width or
grade.
Thoroughfare or Arterial Street Paving.
A. The cost of paving forty-one feet (41') or less
width streets adjacent to low density residential
property or forty-five feet (45') or less width
streets adjacent to commercial or institutional
property shall be borne by the property owner and/or
developer.
B. If the City requires that the paving be wider than
the widths stated in Item V-A the cost for the
additional paving width shall be borne by the City.
C. In the case of an access-road-tYpe paving, the
adjacent property owner and/or developer shall bear the
cost of paving the access road.
D. On thoroughfare or arterial streets as designated by
the Department of Engineering, which require a
pavement section design greater than City standard
specifications due to load frequency design factor,
costs of construction in excess of such specifications
will be borne by the City.
E. If a developer of a low density residential area
surrenders vehicular ingress and egress privileges to
his property by backing up or siding the lots in his
development to a thoroughfare or major arterial street,
his share of the cost for paving of the arterial street
at the rear or side of those lots will be fifty (50%)

of the normal property owner cost in Item V-A above.
The plan for any such development must be approved
by the City of Plainview, and must include a statement
on the plat denying vehicular access to the thoroughfare
or arterial street. On any plat of record prior to the
date of adoption of this policy, the arterial or
thoroughfare paving cost to the property owner of any
low density residential lot backing up to a thoroughfare
or arterial street will be fifty percent (50%) of the
normal cost in Item V-A above regardless of ingress or
egress.
Street Widening.
A. If curb, gutter, and paving exist on a street and the
property owners request widening, they shall bear the
cost of the widening.
B. If the City initiates the widening of such street
paving as described in Item VI-A, above, the City shall
pay the total widening cost.
C. If only strip paving exists and such paving has been
constructed at the expense of anyone other than the
City of Plainview, the property owner shall pay only the
cost of widening. If the existing strip paving was
constructed at the expense of the City of Plainview the
property owner's cost shall be determined as if the
street were undeveloped. If any replacement or grade
adjustments of the existing paving are necessary, the
City will pay the cost of such work.
D. In Items VI-A and VI-C above, if the City requires the
widened street to be wider than forty-one feet (41')
adjacent to residential property or forty-five feet
(45') adjacent to commercial or institutional property,
the City shall pay for the cost of the additional paving
width.
E. If a funding agency (State, Federal Government, etc.)
other than the City is involved in a City street paving
project, the property owners shall not be responsible
for any paving costs in excess of those required of the
City by the separate funding agency.
SECTION 2. In no event shall the City of Plainview be obligated
to proceed or participate in paving projects under the terms of this
policy if funds are not available or if in the discretion of the City
Council the paving project is not considered to be practical or in
the best interest of the City of Plainview.

SECTION 3. In case of any conflict between the general
provisions contained in I above and any of the specific Pr°visions
contained in II through IV, the s~cific provision which applies to
the project shall prevail.
SECTION 4. This resolution shall not be recorded in length in
the minutes of the City Council but shall be filed for pe~anent
record in the office of the City Clerk.
