RESOLUTION NO. R87-307
A RESOLUTION OF THE MAYOR AND THE CITY COUNCIL
OF THE CITY OF PLAINVIEW, TEXAS RECOGNIZING
THE DESTRUCTION OF PUBLIC PROPERTY, TO WIT:
ONE FRONT LOADING SANITATION TRUCK, AND
AUTHORIZING THE EMERGENCY PROCUREMENT OF A
REPLACEMENT VEHICLE PURSUANT TO LAW.
WHEREAS, on November 21, 1987, a front loading sanitation truck
owned by the City of Plainview was destroyed by a fire; and
WHEREAS, the City of Plainview provides sanitation services for
the citizens of Plainview and such services are necessary to
preserve and protect the public health and safety; and
WHEREAS, the City of Plainview has only two remaining front
loading sanitation trucks to provide sanitation services and such are
insufficient to meet the need; and
W~F. REAS, the destruction of one front loading sanitation truck
has created an emergency situation; and
WHEREAS, state law, pursuant to Article 2368a(1), V.A.T.C.S.,
exempts from the general laws governing procurements by cities and
counties a procurement made necessary by unforeseen damage to public
property, machinery or equipment; and
WHEREAS, the destruction by fire of one front loading
sanitation truck has made necessary the procurement of an additional
vehicle due to this unforeseen damage to public property:
NOW, T~RREFORE, BE IT RESOLVED by the Mayor and the City Council
of the City of Plainview, Texas that the destruction of public
property, namely one front loading sanitation truck, has created an
emergency situation in respect to the provision of sanitation
services to the citizens of Plainview and the Mayor is hereby
authorized to enter into an agreement for the procurement of a
replacement vehicle as authorized under Article '2368a(1), V.A.T.C.S.
I James P. Jeffers, City Manager for the City of Plainview,
hereby certify that the above Resolution was adopted by the Plainview
City Council on November 24, 1987.
