RESOLUTION NO. R87-314
A RESOLUTION OF THE MAYOR AND THE CITY COUNCIL OF THE
CITY OF PLAINVIEW, TEXAS, AUTHORIZING THE PLAINVIEWPOLICE
DEPARTMENT TO APPLY FOR REGULARLICENSE'S PLATE STATUS FOR
CERTAIN EXEMPT VEHICLES USED BY THE DEPARTMENTS THAT QUALIFY
UNDER VERNON'S ANNOTATED CIVIL STATUTES ARTICLE 6701m-1 OR
6701m-2 IN ACCORDANCE WITH THE REQUIREMENTS OF THIS
LEGISLATION AND HOUSE BILL NUMBER 763; DIRECTING THE CITY
SECRETARY TO SEND A CERTIFIED COPY OF THIS RESOLUTION TO THE
STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION;
DECLARING FINDINGS OF FACT; AND PROVIDING AN OPEN MEETINGS
CLAUSE.
WHEREAS, the 70th Texas Legislature by passage of House Bill
No. 763, has changed the procedures for the issuance of regular
license plates for certain unmarked vehicles; and
WHEREAS, in order for police departments to apply for and
obtain regular license plates, for exempt unmarked vehicles under
the amended provisions of Vernon's Annotated Civil Statutes Article
6701m-1 or 6701m-2, the City Council must pass a resolution
including a description of vehicles involved authorizing the
application for regular license plates for unmarked vehicles; and
WHEREAS, the City Council deems it in the public interest to
take the action necessary Under the new law to allow the vehicles
described herein to qualify for regular license plates.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the City
Council of the City of Plainview, Texas:
Section 1: That in accordance with the requirements of
Vernon's Annotated Civil Statutes Article 6701m-1 and 6701m-2, as
amended, the City Council hereby authorizes the vehicles which are
described in the attached Exhibit "A", which Exhibit is attached to
and hereby made a part of this Resolution for all purposes, to be
exempted from the identification inscription requirements provided
in these statutes and other applicable laws, and that the Chief of
Police, or his designee, shall be authorized to apply for regular
license plates, instead of exempts plates, for these unmarked
vehicles. The Chief of Police or his designee, shall provide the
State Department of Highways and Public Transportation (Division of
Motor Vehicles) officials with copies of this Resolution when
applying for regular license plates, under these statutes.
Section 2: That the City Secretary shall provide appropriate
officials of the State Department of Highways and Public
Transportation a certified copy of this Resolution immediately after
the passage of same.

Section 3: That it is hereby officially found and determined
that the meeting at which this Resolution is passed, was opened to
the public as required by law, and that public notice of the time,
place, and purpose of said meeting was given as required by the Open
Meetings Act, Article 6252-17, V.A.T.S. (Tex,), as amended.
