HomeMy WebLinkAbout01.28.08 BA MinutesBOARD OF ADJUSTMENT MINUTES Ol /28/2008 BOARD MEMBERS PRESENT: James Crossland, M,ax Browning, Mark Hardin, Fred Willis, Larry Gould, STAFF MEMBERS PRESENT: John Castro -Director of Community Services, Katy Seals - Community Services Secretary OTHER GUESTS PRESENT: Clinton Thrasher, Patricia Alvarez, Ramiro Garcia, Heather Leal-Waller, Jeremy Waller, John R. Juazez Mark Hazdin called the meeting to order at 7:00 P. M. FIRST ITEM ON THE AGENDA : SWEAR IN MEMBERS; Fred Willis SECOND ITEM ON THE AGENDA: Approval of November 2007 minutes. (No December meeting}. Max Browning made motion to approve minutes as presented. Larry Gould seconded. Motion carried unanimously. THIRD ITEM ON THE AGENDA: BA Case # 1543 The request of Heather Leal Cruz for a variance to expand on a legal non-conforming use (struc:ture requires an 8' side setback and is sited 4'8" off side property line) and (2) feet of the required twenty-five (25) foot reaz setback as stated in Section 34 of the City of Plainview Zoning Ordlinance to construct a 19'X30' addition in a Single Family (R-1) Zoning District, and being Block 6, Lot 3, Terry Addition, Unit No.2, Plainview, Hale County, Texas the same being 3004 W. 18th Street. Jeremy Waller is present to answer questions from the Boazd. John Castro showed the Boazd pictures of the property and a site plan of where the addition would be constructed showing that it would line up with the existing structure. He explained what a "legal non-coni~orming use" is. There were five (5) responses received from the neighborhood in favor of the variance request and two (2) responses received against the request. One of the against responses stated: "Houses on this block have been in compliance with the code for more than forty years. We see no reason to change now." Larry Gould asked if brick would be used in the construction of the addition. Jeremy Waller said it would be made to match the existing house. Larry Gould asked if the existing meter loop would be moved and Jeremy Waller said it would. James Crossland asked in which direction would the addition drain and Jeremy Waller said it would drain toward the sides. Fred Willis made a motion to approve the variance based on this being; the only logical place for the addition and the mostly positive responses from the neighborhood. Max Browning seconded. Motion carried unanimously. FOURTH ITEM ON THE AGENDA: BA Case # 1544 The request of Tomas Estrada for a variance of twenty-five (25) feet of the required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 25'X25' carport in a Single Family (R-2) Zoning District, and being Block 7, N50' of Lot B, Depot Addition, Plainview, Hale County, Texas the same being 1415 Cedar Street. There is no one present to answer questions from the board. John Castro showed the Board a site plan of where the proposed Board of Adjustment January 28, 2008 Minutes Page 1 of 2 carport would be and pictures of the property. The slab has already been poured centering the house in the front but it does not extend to the curb. .fohn Castro said when applying for the variance, the property owner told him they did not want to put the carport beside the house because they may want to expand the house in the fiiture. There were three (3) responses received from the neighborhood, all in favor of the request. Larry Gould asked if a footing had been completed when the existing slab was poured t-ut since there is no one present, that question could not be answered. Larry Gould made a motion to approve the variance as requested based on the positive responses from the neighborhood and added that there must be an appropriate footing completed if there isn't one existing and that the slab be poured all the way to the curb. Fred Willis seconded. Motion carried unanimously. FIFTH ITEM ON THE AGENDA: BA Case # 1545 The request of Don Williams for a variance of twenty-one (21) feet of the required twenty-•five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 24'X72'5" canopy in a Duplex and Patio Home Residential (2F) Zoning District, and being Unit #2, Lot 39, Westridge Park Addition, Plainview, Hale County, Texas the sanie being 4304 W. 2nd Street. Patricia Alvazez and Clinton Thrasher are present to answer questions from the Board. Patricia Alvazez said this property is Westridge Manor, a retirement home. John Castro showed the Board pictures of the property and a site plan of the proposed canopy. He said there were 2 responses received in favor of the request and one that mazked in favor stating: "I have no objections as long as nothing is constructed facing 2"d St." John Castro told the Boazd the proposed canopy will be facing 2°d Street but the trees should help to lbuffer the site of the canopy. Patricia Alvazez said the canopy will be used to protect employee vehicles from bird droppings from the trees. She said the parking area in the rear of the property is for resident parking. Larry Gould asked how many poles on each side would be used. Clinton Thrasher said there would be six (6) poles or one every twenty-four (24) feet. Larry Gould ~~sked which direction would the canopy drain. Clinton Thrasher said it would drain towazd the trees on 2°d Street. Max Browning asked if the canopy could be constructed on the opposite side of the parking lot. Clinton Thrasher said the vehicles would be unable to pull into the pazking spaces from that direction. Fred Willis made a motion to approve the variance based on this being the only logical place for the carport and the more positive than negative responses from the neighborhood.
