RESOLUTIION NO. R79-136
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, EXERCISING THE OPTION GRANTED TO A GOVERNING BODY
OF A TAXING UNIT NOT TO APPRAISE FARM, RANCH AND TIMBER-
LAND ON THE BASIS OF ITS PRODUCTIVE VALUE AS PROVIDED IN
HOUSE BILL 1060, TAX RELIEF AMENDMENT, ACTS 1979, 66TH
LEGISLATURE OF TEXAS, REGULAR SESSION.
WHEREAS, Article 1 and Article 2, House Bill 1060, Acts
1979, 66th Legislature of Texas, Regular Session, amended
Article 7150.3 TeXas Revised Civil Statutes, defining appraisal
criteria for farm, ranch and timberland; and
WHEREAS, House Bill 1060, Acts 1979, 66th Legislature of
Texas, Regular Session, grants to any governing body of a taxing
unit the option not to appraise farm, ranch and timberland on
the basis provided in Article 1 and Article 2 of said House Bill
1060; and
WHEREAS, it is the opinion of the City Council of the City
of Plainview, that it would be in the best interest of said
municipality not to appraise farm, ranch and timberland on the
basis provided in said Article 1 and Article 2, House Bill 1060,
Acts 1979, 66th Legislature of Texas, Regular Session for the
fiscal year 1979-1980.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Plainview, and pursuant to the authority granted to the
governing body of a taxing unit by Article 5, House Bill 1060,
Acts 1979, 66th Legislature of Texas, Regular Session, that farm,
ranch and timberland shall not be appraised on the basis provided
in Article 1 and Article 2, House Bill 1060, Acts 1979, 66th
Legislature of Texas, Regular Session, and that the Tax/Assessor
and Collector for the City of Plainview, Texas, is hereby ordered
and directed to continue to appraise, assess, levy and collect
taxes on agricultural land in this municipality until such taxa-
tion is precluded by law or by order of the City Council.
