R79-145 O0 n3G A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, AUTHORIZING THE CITY ENGINEER TO ISSUE A STREET USE PERMIT TO THE OWNERS OF THE SKAGGS BUILDING, AND PROVISIONS FOR A WRITTEN BOND AND INSURANCE POLICY INDEMNIFYING AND HOLDING THE CITY HARMLESS FROM ANY LIABILITY INCURRED I RESULTING CONSTRUCTION: UNTIL THE PROJECT IS SATISFACT COMPLETED AND ACCEPTED BY THE CITY ENGINEER: AND AUTHOR THE CITY ATTORNEY TO PREPARE THE NECESSARY LEGAL DOCUME WHEREAS, the owners of the Skaggs Building located at 7' and Broadway desire to construct a new sewer line to better 's, their building; and ~ THE )RILY ZING ITS. .h rve WHEREAS, to replace the existinq sewer line would require the removal and replacement of some of th~ structural supports for the Skaggs Building; and WHEREAS, the owners have duly requested a Street Use Permit, which would allow them to construct a sewer line under the sidewalk, on the south side of the building, west to the public sewer line; and WHEREAS, the owners have agreed to indemnify and hold the City harmless from any liability incurred as a result of the installation, maintenance, repair and use of the sewer, line; and WHEREAS, the Staff of the City of Plainview has no objections to the proposed project: NOW, THEREFORE BE IT RESOLVED, by the Mayor and City Council of the City of Plainview to authorize the City Attorney to prepare the necessary Legal Documents; and to authorize the City Engineer to issue a Street Use Permit to the owners of the Skaggs Building for the purpose of allowing 30 days to construct a sewer line under the sidewalk directly south of the Skaggs Building on 7th Street and require the following: l) 2) that the owners file a written bond, with two or more sufficient sureties, in an amount sufficient to cover the cost o'f restoring the sidewalk and, if applicable, the street in as good condition as it was before the excavation or opening was made therein; the cost shall be determined by the City Engineer; and that the owners shall furnish the City of Plainview a certificate showing that it has enforced (and shall keep enforce at all times, until the acceptance of the project by the City Engineer) a policy of liability insurance with an insurance company authorized to do business in the State of Texas in an anount not less Page 2 ICITY OF PLAINVIEW I RESOLUTION NO. R79-145 O0 037 than $300,000.00 as protection of any liability during or as a result of said construction, and the same shall, in addition to protecting the owners, shall provide therein that it will also protect the City of Plainview. Wayland Mayor, City of Plainview Street Use Peri, it Skaggs Building 7th & Broadway Plainview, Texas Dear Mayor Wayland: The owners of the Skaggs Building, located at 7th & Broadway, Plainviaw, have determined that it will be necessary-to construct a neW~ sewer line to serve the Skaggs Building. The present sewer line runs under a portion of the Skaggs Building. In order to replace the sewer line under the building, it will be necessary to tear out the concrete floor through a major portion of the building. It appears that it w~ald be more practical to tie c~ to the sewer line in the basement, run the sewer line through tb~ foundation on th~ south side of the building and west under the sidewalk to the public sever line. The owners of the Skaggs Building request that the City Council grant to them a street use penuit for the purpose of constructing a sewer line under the sidewalk directly south of the Skaggs Building on 7th Street. The owners of the building will sign an agreement indemnifying and holding the City hanuless frcm any liability incurred as a result of the installation, mainte~, repair and use of the Sewer line.
