CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS APPROVING AND AUTHORIZING THE EXECUTION AND AN AGREE- MENT BETWEEN THE CITY OF PLAINVIEW AND THE TEXAS DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR CONSTRUCTION OF A STORM SEWER SYSTEM AND INCIDENTAL ITEMS WITHIN THE LIMITS OF AMARILLO STREET TO AUSTIN STREET ON U.S. HIGHWAY 70 AND INCLUDING THE CONSTRUCTION OF A STORM SEWER SYSTEM AND INCIDENTAL ITEMS IN AND ALONG QUINCY STREET FROM U.S. HIGHWAY 70 TO TWELFTH STREET AND THE PAYMENT OT THE STATE TREASURER, ACCOUNT TRUST FUND NO. 927 IN THE AMOUNT OF $356,900 FOR THE CITY'S PORTION FOR THIS PROJECT. WHEREAS, the City of Plainview and the State Department of Highways and Public Transportation are working together'to make paving improvements and to install a storm sewer system in and along U.S. Highway 70 and in and along Quincy 'Street from U.S. 70 to Twelfth Street; and WHEREAS,theCity of:Plainview has requested the State Department of Highways and Public Transportation to prepare plans and specifications and advertise for bids on this project and include it in the Highway Depart- ment's construction contract; and WHEREAS, the estimated cost for the City of Plainview's portion for this strom drainage construction is $356,900 which must be on deposit to the State of Texas prior to the accepting of bids for the construction project; and WHEREAS, the City of Plainview must enter into an agreement with the State Department of Highways and Public Transportation authorizing the State to carry out this construction on behalf of the City and agreeing with Highway Commission Minute Order No. 73954 declaring the City to be responsible for the adjustment of utilities on and along this construction path, construct driveways and sidewalks where none exist if they deem necessary, now or in the future, and maintain the portion of work which is in the present maintenance agreement to regulate traffic, permit parallel parking only and prevent encroachment on the right-of-way: NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Plainview, Texas that this Council agrees to and execute an agreement between the State Department of Highways and Public Transportation in the City of Plainview for the construction of s storm sewer system including incidentals in and along from Amarillo Street to Austin Street U.S. Highway 70 and in and along Quincy Street from U.S. Highway 70 north to Twelfth Street and the City Manager is hereby authorized to issue a check in the amount of $356,900 and made payable to the State Treasurer Account Trust Fund No. 927.
