RESOLUTION NO. R82-497
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS EXTENDING THE TIME FOR CONSIDERATION OF THE SOUTH-
WESTERN PUBLIC SERVICE RATE INCREASE REQUEST WITH THIS
EXTENTION TO BECOME EFFECTIVE ON APRIL 23, 1982.
WHEREAS, Southwestern Public Service filed a rate increase
request with the Public Utility Commission of Texas and with all
cities served by Southwestern Public Service on March 18, 1982; and
WHEREAS, Section 43, (A) of the Public Utility Regulatory Act
requires action on or allows implementation of the proposed rate
increase after thirty-five (35) days from filing; and
WHEREAS, Section 43 (D) of said act allows suspension of the
operation of the rate increase for initial period of 120 days for
further study Of such request;, and
WHEREAS, the Council of the City of Plainview finds that additional
time is required for study of the proposed rate increase request and
to conduct a public hearing as required by Section 43 (C) of said act:
NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of
the City of Plainview, Texas:
SECTION 1: Effective April 23, 1982, the operation of the
proposed re¥isions of the
filed on March 18, 1982, by Southwestern Public
Service Co. is hereby suspended for a period of
of 120 days to allow adequate time for study
and to conduct a public hearing before making
a final determination on said request.
SECTION 2: This resolution shall become and be effective
on and after is adoption.
