R82-519 00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS GRANTING A STREET USE PERMIT TO JOHN MARSE AND JAMES ROBISON ALLOWING THE PLANTING OF TWO (2) TREES IN THE NORTH ENTRANCE OF THE ALLEY WAY LOCATED ON 7TH STREET BETWEEN BROADWAY AND AUSTIN STREETS ABUTTING THE PROPERTY OWNED BY MARSE AND SON AND JAMES ROBISON. 199 WHEREAS, the City Council of the City of Plainview has received a request from John Marse representing Marse & Son's and James Robison to plant two (2) red oak trees near the north entrance ~£ the alleys between Marse & Son and James Robison's building; and WHEREAS, these improvements are to be located in the pedestrian right-of-way on public property which would require permission from the City Council for the placement of these trees; and WHEREAS, plans have been submitted showing the location of the these two trees in relationship to the alley way; and WHEREAS, the City of Plainview has.been furnished certificates of insurance relieving the City of any liability caused by the deviation from the standard sidewalk design: NOW, THERFFORE BE IT RESOLVED BY the Mayor and City Council of the City of Plainview, Texas that John Marse respresenting Marse & Son~s and James Robison be granted a street use permit allowing the planting of two red oak trees to be located near the alley way located on 7th Street between Broadway and Austin Streets abutting the property owned by Marse & Son and James Robison. BOX 806-296-5739 June 14, 1982 Plainview Ci'ty Council City of Plainview Plainview, Texas Gentlemen' Mr. James Robison and I request permission to plant two Red Oak trees near the north entrance to the alley between our store and the new SPS building. A copy of the plan shOwing the exact location, as well as two orientation photographs are enclosed. The trees will be located between three and four feet from the sidewalk side of the curb to allow room for customers to h'ave adequate access to their automobiles. The spacing between the trees will be twenty feet. They will be enclosed in east iron tree grates similar to that detailed on the plan. We plan to locate a water outlet in a meter box near the trees for convenient watering. Naturally, we will maintain the trees in top condition. Copies of insurance coverage are enclosed to relieve the city .df additional liability caused by the deviation from standard sidewalk design.
