HomeMy WebLinkAboutR82-523RESOLUTIONNO,.R82~523 -7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS AUTHORIZING THE CITY TO ISSUE A STREET USE PERMIT TO THE PLAINVIEW DAILY HERALD LOCATED AT 820 BROADWAY FOR THE USE OF PUBLIC PROPERTY INCLUDED IN A PARKING LOT TO BE LOCATED IN THE SOUTHWEST CORNER OF 9TH & ASH STREET; PROVIDING FOR AN INSURANCE POLICY INDEMNIFYING AND HOLDING THE CITY HARMLESS OF ANY LIABILITY INCURRED DURING OR AFTER THE RESULTING CONSTRUCTION AND AUTHORIZING THE CITY ATTORNEY TO PREPARE NECESSARY LEGAL DOCUMENTS. WHEREAS, the Plainview Daily Heraldhas purchase the property located at 9th & Ash street and desires to convert the vacant property to alparking lot, to accomodate not only their facilities but ~dd additional public parking to the downtown area; and WHEREAS, the Plainview Dail~ Herald has agreed to pave this area to city specifications and has requested that the City Engineer esgablish a grade for drainage purposes on said property; and WHEREAS, the Plainview Daily Herald has agreed fo. indemnify and hold the City harmless frOm any l'iability incurred as results of installation, maintenance, repair and use of this parking area; and WHEREAS, the Plainview Daily Herald has been advised that should the City of Plainview need touse the right-of-way for any purpose said parking area on the City fight-of-way should be removed and the City of Plainview shall not be liable for any damages resulting to the parking area nor shall City replace said facility,: NOW, THEREFORE BE IT RESOLVED BY the Mayor and City Council of the City of Plainview, Texas that: SECTIONil: The City~e~authorized to issue a street use permit to the Plainview Dail~':Herald,owner of said property, for the purpose of constructing a parking area of which a portion is over public right-of-way. SECTION 2: That the Pla±nview Daily Herald shall furnish the City of Plainview/,on a yearly basis, a certificate showing that Lh~y have enforced (and shall keep enforced at all Limes) a policy of liability insurance with an Insurance Company authorized to do business in the State of Texas in an amount not less than $300,000 with the City of Plainview being named as an additional insured as protection from any liability during, after, or as a result of said construction, and the same shall, in addition to protecting the owner, provide therein that it will also protect the City of Plainview. O0 "' SECTION 3: That the City Engineer work with the Plainview Daily Herald in establishing a grade to facilitate drainage of the parking area. SECTION 4: That the City Attorney is authorized to prepare the necessary l~gal documents to effectuate tgis resolution. PASSED AND APPROVED this the 13th day of July, 1982. E.V. ' We are having this lot blacktopped with a 6'7 base and 1~" hot mix~ The lot is 156' × 112' including city property - total Herald property, is 140' X 100' We request permission to blacktop entire property; also with your permission, I understand the city engineering department will supervise drainage.
