A RESOLUTION 'OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEX~S AUTHORIZING WAYLAND BAPTIST
UNIVERSITY TC) MAKE CUTS FOR TRLRPHONE CABLE
iNSTAI.TATION IN VERNC~ AND 8TH STREET AND ISSUING
A STREET USE PERMIT TO WAYLAND BAPTIST UNIVERSITY
PBOVIDING FOR AN INSURANCE POLICY IND~N/~YING AND
HOLDING THE CITY HARMLESS OF ANY LIABILITY AND
AUTHORIZING THE CITY ATIO~SIEY TO PREPAPdE NECESSARY
WHEREAS, Wayland' Baptist University has recently acquired its
on canlmas Telephone System and is in the process of installing
co, c~t-,dnication cable which requires the cutting and crossing of
Vernon street, the south side of 8th street and the crossing of 8th
street between Raleigh and Smythe; and
WHEREAS, these street cuts Will be made under the supervision
of the City of Plainview and repaired by Wayland Baptist University
in accordance to City specifications; and
?~tEAS, Wayland Baptist University is also requesting that
the City Council authorize the issuance of a street use permit and
the University has agreed to inden~ify and hold the City harmless
from liability incurred as results of the installation of the
underground cable; and
NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of
of the City of Plainview, Texas that:
SECTION 1: That Wayland Baptist University be authorized to
make street cuts on Vernon Street, southside of
Eighth Street and in Eighth between Raleigh and
Smythe, and these cuts shall be under the super-
vision of the City of Plainview, and repairs to
be made by Wayland University in accordance to the
city specifications;
S~CTION 2: ~Ynat Wayl~nd Baptist University be issued a street
use permit and furnish the City of Plainview on a
yearly basis a certificate showing that they have
enforced (and sb~ll keep enforce at all times) a
policy of liability insurance with an insurance
authorized to do business in the State of Texas
in the amount not less that $300,000 with the City
of Plainview being named as additional insured as
protection from any liability during, after or as
a result of said construction and the samm shall,
in additional to be protecting the owner, provide
therein that it will also protect tb~ City.

SECTION 3:
That the City Attorney be authorized to prepare
the necessary legal documents to effectuate this
resolution.

Dear Mr. Hatchel:
I would like to request, on behalf of Wayland Baptist University,
a street use permit to cut Vernon Street at the south side of
Eighth Street. We would also like a permit to cut Eighth Street
between Raleigh and Smythe. The purpose is to install conduit to
hold telephone and closed circuit t~vision cable to those
portions of our campus. We understand we will be required to
repair the streets to city specifications.

Being the centerline of a telephone line crossing
Vernon between Block 60 and Block 61, College .Hill Addition
to the Town of Plainview, Hale County, Texas:
BEGINNING at a point in the east right of way line of
Vernon Street, said point being 12.5 feet East and 19.6
feet South of the northwest corner of Lot 15, Block 60,
College Hill Addition to the Town of Plainview, Hale
County, Texas;
Thence West, at 12.5 feet pass the west line of said
lot, at 87.5 feet pass the east line of Lot 2, Block 61, in
all, 100 feet to the POINT OF TERMINATION of said line in
the wes~ right of way line of Vernon Street, from which the
northeast corner of Lot 2, Block 61 of said addition bears
19.6 feet North and ~2.5 feet East.
