R88-162 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, GRANTING A VARIANCE FROM THE SUBDIVISION ORDINANCE BY ALLOWING THE ISSUANCE OF A BUILDING PERMIT FOR THE CONSTRUCTION OF A NEW PRE-K THRU 4 ELEMENTARY SCHOOL ON SOUTH ENNIS STREET PRIOR TO COMPLETION OF THE PLATTING PROCESS. WHEREAS, the City of Plainview is well aware of the need of the Plainview Independent School District, (PISD), to construct a new Pre-K thru 4 Elementary School to educate the youth of the City and to comply with State mandated regulations on class sizes; and W~RREAS, the PISD desires to come into compliance with State mandates on the number of classrooms by the 1989 school year; and WHEREAS, to come into compliance and have the school constructed by the Fall of 1989, construction would need to be started as soon as possible; and W~RREAS, the Subdivision Regulations of the City of Plainview, also known as Ordinance No. 78-2259, requires all subdivision or platting of the property be completed prior to issuance of a building permit; and .... W~R. REAS, the normal time required to complete the subdivision process and the building permit approval would create an unnecessary hardship in that if strictly adhered to would extend the completion date past the Fall of 1989; and W~F. REAS, the PISD has requested a variance be granted from these regulations; due to the need to complete the school and comply with state mandated regulations by September, 1989; and W~RREAS, the Planning and Zoning Commission has recommended to the City Council by a vote of 5 to 0 that a variance be granted to PISD in regard to issuance of a building permit subject to an agreement by the school to comply with all regulations of the Subdivision Ordinance as well as all other City Code requirements effecting the school. NOW, T~F. REFORE, BE IT RESOLVED by the City Council of the City of Plainview, Texas in accordance with Section 6:12 of Ordinance No. 78-2259, as amended, wherein the Planning and Zoning Commission may grant a variance t° the regulations imposed by the ordinance, the Plainview Independent School District be granted a variance from Ordinance No. 78-2259 so a building permit may be issued for the construction of a new Pre-K thru 4 Elementary School to be constructed on school owned property adjacent to South Ennis Street, 1 of 2 115 south of Southwest Third Street subject to the school's agreement to comply with all Subdivision Regulations as well as all other City Codes and requirements which would affect the proposed school. The variance granted by this Resolution is not a waiver of any requirements but is to permit the issuance of a Building Permit prior to completion of all requirements and does not take effect until this Resolution is approved by an affirmative vote of the Plainview Independent School District Board of Trustees.
