R88-188 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, ADOPTING A CITIZEN COMPLAINT PROCEDURE, PERTAINING TO COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS. WHEREAS, the Texas Department of Commerce, Texas Community Development Program, is requiring that all cities have a written complaint procedure whereby any citizen will have an opportunity to avail themselves of a complaint procedure when actions of the City are questioned regarding an application of grant for CDBG Funds; and WHEREAS, a copy of said policy is hereby attached and made a permanent part of this Resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview, Texas, that the attached citizen complaint procedures are hereby adopted for handling inquiries or complaints concerning and application or grant for CDBG Funds. E V Rldlehuber, Mayor ATTEST: Carla Re~se, City Secretary ~es P../'Je~,~ Manager APPROVED AS TO FORM: David Blackburn, City Attorney 152 CITY OF PLAINVIEW CITIZEN COMPLAINT PROCEDURES Community Development Block Grant Funds Any citizen will have an opportunity to avail himself/herself of the following complaint procedures when actions of the City of Plainview are questioned regarding an application or grant for CDBG Funds. Any citizens appealing the City's actions must site, in writing, to the Mayor, the specific violation regarding the City's actions. All complaints must be handled in accordance with the procedural guidelines below: A citizen must notify the Mayor in writing of the alleged violation within five (5) working days following the City's action. Within fifteen (15) working days after the receipt of the complaint, the City Council shall convene to hear the complaint. In an open meeting, the Council will consult with the complainant and consider the complaint. With a quorum present, the Council shall vote to accept or deny the complaint. If the Council accepts the complaint, appropriate action shall be taken to remedy the complaint to the satisfaction of the complainant and the Council. If the complaint will be required. is resolved, no further action If the appeal is unresolved, the City will prepare a complaint file. The file will include: a. A copy of the complaint. b. The City Council response. c. Comments from other interested parties.
